Re: Running Serial Numbers of weapons of CHL holders.

I have no doubt that the serial number running is just a way for disproving LEO/
Agencies to harass law-abiding gun owners. And even though it's technically a violation of your rights, the roadside is no place to litigate your case. If it were to happen to me, I'd comply during the incident then bring up my objections with the supervisor and/or agency head.

Is the best eay to handle this to avoid serial numbers being ran.. When you see the blue and reds behind you. Just unholster and stick your gun in a safe place under your seat etc? Then you are not armed if pulled over?????

Ive had my serial number ran twice out of 5 stops. I only get warnings tho:-). Still i dont like the snooping. Same reason i tell them now when they ask to look inside. I feel like we should have the right to say no to a serial search...

So is disarming while being pulled over but before leo gets to your window the answer to noot getting disarmed or sn ran?
I think that all of the extra movement necessary for what you suggest could raise the leo's alert & cause the stop to go south in a hurry. Especially since you'd be trying to hide a firearm.

Re: Running Serial Numbers of weapons of CHL holders.

I could be wrong (it's happened quite a bit since I've joined this board), but I believe "on or about your person" is anywhere within your reach. So carrying in the center console would require you to show your CHL & inform the officer that you are armed. But, as already has been stated, there's no official penalty for not showing the CHL. That's not to say that not showing the liens wouldn't set an unpleasant tone for the rest out the stop, though.

It doesn't matter whether the gun is in the console or on your person while in the car. If you have a CHL you are required to identify that you have a CHL when you are asked to identify yourself.

Then again, there is no penalty if you don't.
Since you are only required to have your CHL on your person when carrying, you are only required to produce your CHL when you are carrying. If you are not carrying a concealed weapon, then you have no duty to inform the officer that you hold a CHL. All this is a moot point for me since I carry everywhere that I am legally allowed to.

but aren't the serial numbers already in the atf database? When i purchase a new firearm the serial number is listed on the atf form.

i would say private sales..the number may never get transferred to the new owner.
interesting.
That form stays in the possession of the owner of the gun store until such time as that store goes out of business, at which time the form passes on to BATFE where they are not supposed, by law, to record any of the information on the forms.
Not always true, when you purchase two handguns in a five day period it has to be logged on the ATF multiple handgun purchase form. This form is faxed to the ATF and they have all your info and the firearm info. They do check the serial numbers on these forms, I have had them call me when I wrote the wrong serial number. So, they can get the info on your handgun purchases.
True, for that special case, but then it makes me wonder where they are finding the serial numbers to compare them to.
When a weapon is reported stolen, the serial number (if provided by the theft victim) gets relayed into a database that law enforcement has access to. This is what the disarmed CHL serial number would be checked against.

Re: Running Serial Numbers of weapons of CHL holders.

I believe that if your weapon is in a lock box & not on your person, then you can answer no to the question of whether you are armed or not. I also believe that retrieving the weapon from the lock box would require consent or a warrant. Usual disclaimers apply.
