The law permits the officer to disarm the CHL holder. He does not have to have probable cause to disarm, a warrant is not required for him to run the serial number just as he does not require a warrant to run a drivers license check on you once you hand him your DL. The sole discretion to disarm is that of the officer's. no one, meaning the courts or his/her superiors is going to second guess an officer's decision to disarm someone. I have a very close friend that has been through this. Yes you can be sued. The law says you have civil immunity which means a jury should not levy any damages against you.

I have been stopped several times, disarmed once. In the majority of the cases, the officer just handed my CHL back to me, in one instance the trooper asked what I was carrying, at the time it was an H & K P7M8,, he had never seen one, so we had show and tell on the side of I 45 near Fairfield.
