Re: Texas to Sturgis

You are better than me. I personally don't go anywhere, where the number of people present exceed the number of bullets available.

Re: DPS Serial Number Check Strategy

Don't talk to me then. Your right. I was a LEO for 15 years, I simply try to bring in that perspective. The bottom line is simple, the law says he can do it. You can refuse, but it won't end well for you. If I was still on the street, the odds of me disarming most would be slim. But if I asked you t...

Re: DPS Serial Number Check Strategy

Folks, this really isn't as complicated as you make it, or want to make it. I realize no matter how simple this gets broke down some here will disagree. That is your right. Hey if we all agreed this board would be real boring! Let's say you get pulled over. You produce your CHL and DL and the office...

Re: DPS Serial Number Check Strategy

The law permits the officer to disarm the CHL holder. He does not have to have probable cause to disarm, a warrant is not required for him to run the serial number just as he does not require a warrant to run a drivers license check on you once you hand him your DL. So until someone wants to challen...

Re: DPS Serial Number Check Strategy

The sole discretion to disarm is that of the officer's. no one, meaning the courts or his/her superiors is going to second guess an officer's decision to disarm someone. All an officer has to say is that he did it for his safety, end of discussion. When I was a Sargeant, which was long before CHL,ha...

Re: DPS Serial Number Check Strategy

Cover the serial number with tape! Seriously? That in itself raises reasonable suspicion, which leads to probable cause. Not a real good idea. Once the officer uses his lawful authority to disarm you, there is nothing that prevents him frm running your serial number, just as there is nothing that pr...

Re: CIVIL LAW SUITS AND THE CHL HOLDER......

I have a very close friend that has been through this. Yes you can be sued. The law says you have civil immunity which means a jury should not levy any damages against you.
The plaintiff attorney said he would never pursue that again...

Re: Church Volunteer Security Groups

Well this bill again shows that common sense and politics do not mix. A special interest group used less than truthful arguments to kill the bill. As Charles pointed out this bill posed no threat to the security guard industry. The churches that cannot afford to hire guards now aren't going to hire ...

Re: employer weapons policy opinion

IANAL, but, it seems to me that their wording basically says leave it in the car. Premises by state law does not include parking lots, they give you the out in stating except as applicable by state law. Leave it in the car. Should you decide to carry outside of that just remember concealed means jus...

Re: Running Serial Numbers of weapons of CHL holders.

Many of you have posted about the PC needed to run the serial numbers on a gun. Now, admittedly I have been out of Law Enforcement for a long time. But when I was in, the PC was needed for the stop. After that we used what was referred to as the arms reach doctrine, meaning I could, without a warran...

Re: advice....company vehicle.... with co workers

I have been stopped several times, disarmed once. In the majority of the cases, the officer just handed my CHL back to me, in one instance the trooper asked what I was carrying, at the time it was an H & K P7M8,, he had never seen one, so we had show and tell on the side of I 45 near Fairfield.

Well you can say what you would do all you want. Until you are in an armed encounter, regardless of the age of the actor, you do not know how you will respond.

Re: You'll Love What DPS in Palo Pinto County is Doing!!

First, as you all know, a peace officer has the authority to disarm you. You might not like it, but get over it, the law says he can do it. I have been stopped several times and only disarmed once. I was not the least bit offended by it. As a former LEO I completely understand it. No big deal. Secon...
