He had just smoked marijuana with the neighbor who was killed a week or so back. I guess the marijuana gave him the munchies and the ice cream was a fix.WildBill wrote: ↑Sat Oct 12, 2019 3:18 pm I have been reading some news reports about the shooting of Botham Jean and many of them
reveal that he was eating vanilla ice cream in his apartment when he was shot and killed.
Am I reading too much into this or would it have mattered if he was eating chocolate ice cream?

Re: Officer Invades Apartment, Shoots Resident
If I was Guyger I don’t know that I would want to gamble that 10 year sentence and serving just 5 years. If she is retired and again on murder it is possible she would get double the 10 or more.Grayling813 wrote: ↑Wed Oct 09, 2019 3:26 pmAnother reason for a higher court to declare the verdict void and to be retried?

Re: Officer Invades Apartment, Shoots Resident
Lee Merritt and Ben Crump are useless, race baiters, and the biggest bigots I have ever met. It is such a shame to see a family like Botham Jean (upon all appearances seem to be a Christ loving family) molested by those two.

Re: Officer Invades Apartment, Shoots Resident
One of the attorney’s for Jean family has been asked to investigate. As the old preacher said, “gag a maggot off a gut wagon.”
If someone was doing this to effect the trial they were late. His testimony wasn’t what sealed the deal. I did hear him testify to meeting Botham that day and he said, “ I met him and we smoked weed and sang gospel songs.” All he said about the shooting was he never heard Guyger give commands. Not much in my opinion.

Re: Officer Invades Apartment, Shoots Resident
This is not mine I borrowed it from the bottom of a letter I received. It may help save someone from repeating what the officer did here if we would just think about it. When I read the statement I immediately thought of this mess here.
Please be alert, safe out there and remember assess every situation asking yourself, “If I didn’t have a weapon on me at this time what would I do?” That one question could keep you from being launched into a traumatic incident that will change your life.

Re: Officer Invades Apartment, Shoots Resident
LaBRat he is not on duty. She is at her home (she thinks) and there is NO duty to retreat in Texas. She didn’t have to back out to cover and wait. If she had really been in her own house does anyone really think she should use a less lethal weapon first?
If you are in your own home, someone is inside, they startle you, and you have already opened the door are you going to pull your knife first, back out, or draw your firearm?
The problem is we all have different answers. Some will go to the fight and some are going for the run, hide, fight scenario. Nothing wrong with either way. It is also easy after we have studied this for a while we all have an opinion now. She had to make her decision in milk-seconds, as most of us would if faced with this situation.
I personally think that we need to make the decision now. Ask ourselves what will I do? If we are someone who just couldn’t live with the fact that you had to take a life so you or your loved one could live then there is no reason for you to be carrying a deadly weapon. I say again I see NOTHING wrong if that is the way you are. Just make sure you know what you will do if...

The most power victim statement (Botham’s brother) I have heard and ended like nothing I have seen. I am old man, but I couldn't help it I cried.

Re: Officer Invades Apartment, Shoots Resident
His door had a malfunction and bolt would not lock. When she put her key in the door it opened because it malfunctioned. According to testimony he was setting on his couch eating ice cream with the TV and Laptop on. They testified that he was standing up when she opened the door.Ruark wrote: ↑Wed Oct 02, 2019 3:31 pm Did she walk INTO the apartment and shoot, or did she shoot him when he answered the door? Lots of contradicting details here. She said the door was open, but those steel fire doors automatically shut, tight as bank vaults. And if the door was open, why was she, according to neighbors, yelling "let me in!"?
I imagine from the testimony and listen to the race-baiting attorney's they will be suing the apartment owners for negligent. It is my understanding they have already made it easier for the renters to see which floor they are on now.

This is because she allowed “mistake of fact.”philip964 wrote: ↑Mon Sep 30, 2019 11:27 pm https://news.yahoo.com/judge-allows-cop ... 03550.html
Judge allows castle doctrine for defense.
carlson1 wrote: ↑Thu Sep 26, 2019 10:16 pm This is also interesting from a prosecutor that is not involved in this case said.
"It's a really legally interesting case, how 'mistake of fact' can be such a powerful defense,"...If the jury believes she was mistaken in entering the wrong apartment and perceived Jean as a deadly threat, Guyger could be acquitted of murder.
"So the real question is whether the mistake of fact defense negates that intent, and if it does she should be found not guilty," ...

I believe it does that is why you should never shoot to kill or even to wound. You are wanting to “stop” the threat.C-dub wrote: ↑Mon Sep 30, 2019 10:14 pmWouldn't that then apply to anyone who shoots another person? That seem like a really broad brush.srothstein wrote: ↑Mon Sep 30, 2019 9:35 pm That means she had the culpable mental state required for murder.

My health is not well today, but while laying here watching the testimony I honestly didn’t see the tears that matched the crying. I am in no way way making a judgement that it was not real I am just just giving my two cents.Grayling813 wrote: ↑Fri Sep 27, 2019 1:55 pm Guyger testifies....she better hope that she sounded more convincing to the jury than this article's account.
