Re: concealed license law unconstitutional?

If I understand DKSuddeth's original point, to wit "The USSC opinion clearly states that 'A state may not impose a charge for the enjoyment of a right granted by the federal constitution," then what he is saying is that the Texas CHL law is unconstitutional because it charges a fee for th...

concealed license law unconstitutional?

Hello all, I haven't posted here in quite awhile but glad to be back. Looking for opinions on this. It is my contention that the concealed license law, as it stands right now, is a violation of the 2nd amendment. I know that alot of people will say that the 2nd has never been held against the states...

that looks like an older sign from the 80s. 30.06 overrides that, in my opinion. I would think it could be ignored. IANAL

The purpose of a CHL is to keep the weapon concealed so that if you need it you have it, but not to let the bad guy know that you have it. Let us all be very clear on this point. The purpose of a CHL is MOST DEFINITELY NOT!!!!!! to keep the bad guy from knowing you have it. The ONLY reason we have ...

We are a new group, less than 6 months old now, and we are in the process of organizing our regions. Is the group modeled after or inspired by the Virginia Citizens Defense League? They're a very effective group in their state. Kevin Yes Kevin, Gary got alot of info from Phillip Van Cleave (of VCDL...

the best way to prevent gun seizures from happening is to have a plan already in place. You MUST become close with all of your neighbors, especially those that have guns. You MUST, as a whole, believe in keeping your guns. You MUST, and this is the biggest, be ready 'as a whole' to repel any governm...

We are a new group, less than 6 months old now, and we are in the process of organizing our regions. Yes, we are going to push for liberalizing our carry laws and get back real gun rights by getting open carry in Texas. Dr. Suzanna Hupp initially pushed for this when she was elected to the state leg...

IIRC, isn't there a precedent about definitions that are not specifically detailed in the statute, that any prevailing definition has to apply or that particular statute would have to be ruled unconstitutionally vague?

Your snippit from that case does not, IMO, set precendent that Texas cannot regulate weapons by law. Have you read the actual case and the full decision? I have. I have too. not sure where you're going with that. This case was about the abuse of that right, not the right itself. It should also be n...

Please cite the 'court decisions and precendents" of which you write. I have in the first post. court decisions do set a precedence, right? To answer your next queston; It does not. so if a court ruled that some law congress made that DOES abridge the freedom of speech, then we no longer have ...

so, despite court decisions and precedence, a court would let stand an arrest and conviction of an offense against an unconstitutional state law?

I guess my next question would be when does a court become illegitimate?

serious question

open carry is not legal in Texas, by law, but I have serious doubts about the constitutionality of said law. Has it ever been challenged? anyone know the case? This is why I ask. Cockrum v. State, 24 Tex. 394 (Tex. 1859) "The right of a citizen to bear arms, in lawful defense of himself or the ...

one would think that the luby's massacre would be all that was needed to learn that carry should be allowed anywhere, however, the gun control advocates needed to look out for those 'squeamish' ones about seeing guns in places that only criminals should be allowed to carry.

I might also suggest that you look for a different insurance company. who knows what could happen to you if something more serious evolves from the insurance company not doing something for you as they said they would.
