And this piece of garbage was not charged with attempted murder why?

Yeah, that's what I'm wondering, too. Unfortunately, the article from local paper about the incident has comments disabled.

I'm going to say that as the gun control advocate and the concealed carrier struggled for control of the gun while in the vacinity of the holster the trigger was pulled. At that point the gun owner released his hold on the gun, the gun control advocate then took control of the gun ( pun intended) and then not being trained pointed it at anyone nearby.

Otherwise to me it is attempted murder.

Not sure why it is not theft, other than this is a liberal part of Kansas ( it's not Liberal Kansas, another pun) and the DA there probably doesn't like people having guns.

I too was wondering why he wasn't charged for attempted murder.
