Committee substitute removes language for 'dual points of retention' for holster, leaves 30.06 alone, and adds 30.07 for open carry. Seeing some good support for the bill.

I have learned that all committee substitutes in Homeland Security & Public Safety were "withdrawn subject to vote" meaning they were laid out and debated, then they were withdrawn until the vote on the individual bills. This is usually the following week when the Committee meets again.

CSHB700 removes the harmful and dangerous amendments to TPC §30.06 and it removes the problematic "dual points of resistance" language, so it has our full support. It's still a very board bill and it will be necessary for Rep. Lavender to protect it against anti-gun amendments in committee and on the House floor, but we trust he will do so just as he made sure the committee substitute addressed our concerns.

Again, Alice Tripp will be testifying in favor of CSHB700.

Got this email today from Rep. Lavenders office
Good Morning –
 
The hearing yesterday went very smoothly. We had many passionate individuals along with Alice Tripp from the Texas State Rifle Association testify in favor for HB 700 “Open Carry”
 
We laid out our Committee Substitute to address concerns with “dual points of resistance” and Section 30.06 signage.
 
Now you may carry your handgun in any type of holster. Also, we created a different sign to allow property owners to ban open carry at their discretion. For clarification, Section 30.06 still bans concealed carry and 30.07 bans open carry. Therefore, if a property owner wants to ban both types of carry, her or she will have to post both signs.
 
Only one person testified against the bill. Thankfully, her testimony was incoherent and not very strong.

Bills are usually, but not always, voted on the week following the public hearing. There were a lot of bills debated yesterday, so it may take a little longer. If it goes past 2 weeks, then it's time to start worrying and turn on the phones and faxes.
