Amicus Curiae Briefs for 2A Incorporation

Dave Hardy, at his Blog "Of Arms and the Law," has posted links to some briefs supporting the request for the SCOTUS to take up the 2A incorporation case out of Chicago (7th Cir Court, I think). Rather than copy all the links over, just go to Mr. Hardy's blog post and check'em out.

The Texas AG authored the brief for 33 states. California's AG, the Attorney General formerly known as "Governor Moonbeam," has also filed a brief, supporting taking up the case and supporting incorporating the 2A against the state governments -- including California. Mr. Hardy has an interesting comment about that from friend who knows Cali AG.

Here is (part of) the reasoning of California's brief:
California has a strong interest in protecting the constitutional rights of its citizens. But unlike many states, California has no state constitutional counterpart to the Second Amendment. Unless the protections of the Second Amendment extend to citizens living in the States as well as to those living in federal enclaves, California citizens could be deprived of the constitutional right to possess handguns in their homes as affirmed in District of Columbia v. Heller, 128 S. Ct. 2783 (2008).
I, at least, would not have predicted this... ;-)

The Cato Institute has also signed an Amicus Curiae Briefs for 2A Incorporation in SUPPORT of it.

Good luck on that.

Either way it is extremely difficult to amend the Constitution.

Be thankful for that - Could you imagine what kind of changes could have happened during certain presidencies if it wasn't such a tough task to accomplish!
