Post Office off-limits?

Went to the Post Office in Garland today, South Station off Oates and Broadway. There were no signs of any sign, except talking about armed robbery of a post office yada yada yada and some signs for their security system. I've been keeping my eyes out for signs to practice even though I haven't made it to a class yet.

They off-limits or no?

Depends on who you ask.

18 USC 930 states that carrying a firearm on Federal property is illegal, except "for hunting and other legal purposes." Those who believe in the 2nd Amendment believe that covers licensed CCW. Those that would like to see our 2A rights taken away say it doesn't; that other legal purposes covers LEO's.

And, of course you also have those who respond with, "It's better to be judged by twelve, than carried by six."

For myself: I carry.

I really live in fear of Federal prisons, so I won't carry at a post office unless I were to see an opinion from the atty. general stating that chl's are ok for post offices. I rarely have a reason to go to a post office, when I can accomplish what I need at a place where I can carry w/o questions.

Since I tend to avoid post offices anyway, so it really doesn't bother me at all.

Just keep in mind that 39 CFR 232.1(l) of the US Postal Service Regulations states: “Weapons and explosives. No person while on postal property may carry firearms, other dangerous or deadly weapons, or explosives, either openly or concealed, or store the same on postal property, except for official purposes. Some believe that the CFR eliminates the 'lawful purpose' component of the title 18 section and makes it flat illegal. I don't know. I am with Nitrogen - until I see a clear statement re 18-930, I will avoid packing in Federal facilities.

Go to http://www.thegunzone.com/rkba/rtc-usps.html and read what he says. Then make up your own mind as to whether you want to carry in the PO or not.

I have read it, but still am not certain about the legality. The above informatin may all be true. But the cost, aggravation, and everything else that would be involved in convincing the local LEO and DA makes it not worth it.

I'm in and out of the PO in under a minute when I check my PO box. Sometimes I do carry, sometimes I don't.

I wish our AG would issue a ruling on it.

40fiver and I both live in small towns, and I see no problem in carrying in these P.O. 's. In my case, the people that work there know me by sight, and I seldom go into the counter area.

NO - IMO - they are NOT off limits...

The CFR cannot trump the U.S.C., and the U.S.C. allows lawful concealed carry in a federal facility.

Slight, but very significant, correction: it says that firearms "in federal facilities" is illegal, and then defines "federal facilities" as "buildings, or portions of buildings, where federal employees work".

This is a very important distinction when it comes to parking lots or "grounds".

Oh, and 18 USC 930 also says you can't be prosecuted unless notice is provided by a sign on the entrance.

For myself: I carry.
As do I. My small PO has no 18 USC 930 warning, just the "armed robbery" and "assaulting a postal worker" notices. Same for the major substation on this side of town. The main PO downtown is the federal building, with courts, FBI, IRS, USMS, and other federal offices, which changes the equation. Under 18 USC 930, a court can issue a rule against firearms not just in the building, but on the "appurtenant grounds".

Other than the obvious wealth of information here, is there a way to get an official "ruling" on topics like this? I know laws are open for interpretation, but I'd like to be able to pin someone on facts.......post master? Local LE?

I had wondered the same thing, then I figured I'd get a different answer with each person I asked. I mean. I can't get a straight answer on where to print on an envelope, I am sure firearms would be more than the Post Office could process. IMHO :)
