2006 Conviction Rates from the DPS web site

http://www.txdps.state.tx.us/administra ... rt2006.pdf

Towards the bottom of the list:
"UNL CARRY HANDGUN LIC HOLDER"
and
"UNL CARRYING WEAPON"

Did these guys forget their license at home and got busted?

What about the one guy:
UNL POSS METAL OR BODY ARMOR BY FELON
How did a Felon get a CHL?

What about this guy:
PROH WEAPON SWITCHBLADE/KNUCKLES
I'll bet he wishes he just carried a gun instead.

Just makes you want to go "Hummmmmm".
See you at the range
NRA Life, TSRA Life, USPSA Life, Mensa (not worth $50 per year so it's expired)

No one who knows is talking.

The only explanation that makes sense to me is that these were plea bargains from more serious offenses. The category UNL CARRY HANDGUN LIC HOLDER has 22 convictions of non-CHLs. How could that be?

Maybe they had expired CHLs or didn't ID themselves to LEO or didn't have the plastic with them or had non-resident or out of state CHL? :???:

That's possible, but a person who does not have a valid CHL (expired or from a state without reciprocity is guilty of PC 46.02 UCW, not PC 46.035 UCW by a license holder.

I find it hard to believe that someone who left their valid license at home would be convicted. Arrested, yes, but I think most judges would dismiss the charge, as they do for people who forget their driver licenses.

I would think so too, but I can't think of any better explanation. :???:

Like I said, it could be a plea bargain.

Carrying in a bar or school is a felony. The DA might decide to offer a misdemeanor plea in place of it. Most people will fight a felony in court, and DAs have to budget their prosecutions to some extent.

Do you know of anyone who had a valid CHL and was convicted because he forgot to carry it?
