A friend of mine attended a CHL class this past weekend and I'm slightly concerned with a question on the written test.

The question in question was the following (it might be slightly paraphrased):

Whether carrying or not, if being pulled over you must:
a) when requested by officer show both IDs
b) turn on dome lights
c) place both hands on top of wheel
d) all of the above

She answered D and this was apparently the correct answer however this seems wrong to me. None of the answers are correct since, as I read it, according to Government Code Section 411.205 showing your CHL is only required while a gun is on or about your body. All of those options are possibly good advice but, as far as I understand it there is no legal requirement for any of these things, and A is only required while carrying. It concerns me when it seems instructors make up their own laws.

On a side note she passed her shooting test with a 249/250.

If "must" is replaced by "it is advisable to" then the 'D' would be the correct answer. IIRC, something other than "must" was used on the test.

you must show your chl by law but now you cant be punished for not doing so. I would advise you do however as they will see it when they run your license.

It's entirely possible she could be remembering incorrectly. Is the test itself standardized? I probably should know that. The more I think about it the more that question seems familiar to me. My renewal is coming up soon so I guess I'll see.

The actual question is not what was posted (at least on the current Test), it is worded differently!

I'm really surprised that nobody has posted test questions on the Internet. I figure CHL instructors are probably told not to do so, but in this age of Wikileaks and such, there still doesn't seem to be a public posting of the written test questions. (Unless my Google-Fu just isn't up to snuff.)

The actual test question is as follows:

You have a concealed handgun license and carry a revolver in the glove compartment of your car, when stopped by a police officer, you should:
a) Roll down the window before the officer approaches
b) Keep both hands in plain sight on top of the steering wheel
c) Give the officer your driver license AND your concealed handgun license
d) All of the above

That seems to be right to me. I think part of the reason they specifically mention off body carry is so people understand that a CHL is not covered under MPA. Maybe totally off but it seems a good enough excuse.

That is the correct answer. You do not have to automatically show the CHL, but if asked for it you must be able to produce it if you are carrying.

My take is that the question pre-dates the MPA. There is nothing in the MPA that makes its exception to 46.02 inapplicable for CHL holders.

This has nothing to do with MPA. "Carrying" is "on or about your body." When you have your handgun on or about you and CHL in your possession, 46.02 does not apply.

I'm not sure I get your point. The CHL test question talks about "in your glove box". That has always been considered "on or about your person". Prior to MPA, you needed a CHL to carry in your vehicle (absent other non-applicability like sporting activity, etc.). Now you don't, because 46.02 has specific language excepting vehicle carry.
