Valid 30.06 sign??

Valid 30.06 sign??
Saw this over Memorial day weekend. It is at an outlet mall and this store only has one door, from the outside. White lettering on clear glass, but they have a white wall right behind the sign, so it is next to impossible to read. Let's assume that the wording is correct for purposes of this discussion. Refreshingly, this was one of only a few stores that had signage (San Marcos outlets).
I almost missed the signage completely since it is at the far end of the stores window and is as far as they could get from the door. I saw the 30.07 on the other end of the window, so I looked extra hard for a 30.06 as I was CC'ing at the time. The good news is that I was able to use this as an excuse not to go with my wife into this store (Tory Burch). The bad news is that there were no other stores that interested me, so I decided to just take a couple pictures instead.

Pretty reasonable argument that it's not "contrasting (with the background) colors". You risk a $200 ticket if you didn't see it and walked past and were subsequently discovered.
You also risk the lifelong stigma of being convicted of a crime (class C misdemeanor) similar to speeding or watering your lawn on the wrong day. I'm not sure your neighbors would ever speak to you again and you would be shunned at Church, lose your security clearance, and your TWIC card, and never be able to get TSA Pre-Check again.
Plus you might "take the (proverbial) RIDE". And a hotshot DA with an attitude might get a grand jury to indict you for Capital Murder.

there are instances where looking for 06/07 signs is like a game of "Where's Waldo?" thanks to an apparent innate inability to understand the word 'contrasting' on the part of some folks.....I've named it "H.E.B. Syndrome".

I'd like to think that any officer with a lick of common sense and an understanding of the law would forego the citation while explaining to the owner that the sign is not in compliance due to the non contrasting colors and location. It would be nice if the legislature would define the sign requirements so they were a little less ambiguous, maybe require white letters on an opaque black background or black letters on an opaque white background.ScottDLS wrote:Pretty reasonable argument that it's not "contrasting (with the background) colors". The 07 signs at our HEB are hard to see also. They did put a poster board behind it but it is a light pink and it is not much better. I guess they couldn't find a dark one. My biggest complain with the HEB signage is that they are on sliding doors and tend to slide behind product displays when the doors are open. If the doors are open as you approach my local HEB it is physically impossible to see the signs without moving boxes of watermelon or whatever. Of course, those are 30.07 signs, so you will likely just get notice if you miss them while open carrying.Bayoutalker wrote:The 07 signs at our HEB are hard to see also. I have an even better idea. Strike all existing language regarding signs completely. If you don't like open carry, then put a sign to that effect where people can see it. If someone OC's past the sign, ask them to cover up or leave. If you don't like CC, or cancer patients, or AIDS patients, or liberals, or whatever, and you can't tell that someone is in this category, then just go on being blissfully ignorant. If for some reason you can tell, then see the procedure above. You could also install a metal detector if you are really all that concerned about the mere presence of an unseen gun.

Ours is the same way. I don't see how that is conspicuously displayed. I can't tell from the photo, but how close is the almost invisible sign to an actual entrance? it doesn't appear to be very close to one.
If it's not, than someone walking by an impossible to see sign, a great distance away from the entrance, would be very hard to enforce. JMHO

It's a typical mall location, so the front window is maybe 40 feet across (rough guess). That would make the sign about 20 feet from the door, with the 30.07 sign an equal distance from the door on the opposite side. My personal opinion (and IANAL), is that this sign would not be valid. The law is pretty clear regarding signage. The law states that;
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both English and Spanish;
(ii) appears in contrasting colors with block letters at least one inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to the public.
Since clear is defined as the absence of color these signs have no lawful authority. Clear is not a color and therefore not appearing in contrasting colors!
(B) a sign posted on the property that:
