NY is Safer Today - UPDATE - DA Declines to Prosecute

Post by JJVP »

Gregory D Dean Jr., 31, of Hopewell Junction, was pulled over on Sunday evening in New Lebanon because the vehicle’s license-plate lamp was not working. Troopers found Dean with a legally registered pistol with a magazine that contained nine bullets, two more than the recently passed “SAFE Act” allows. Police charged Dean with unlawful possession of certain ammunition feeding devices, third-degree aggravated unlicensed operation and other vehicle infractions.
NY residents should be very happy and relieved that those extra two rounds are no longer being carried around in NY. Should be able to get a good night sleep tonight. :banghead: :banghead: :banghead: :banghead: :banghead:

Well...might make for a good SCOTUS test case ala DC gun ban.

You have to wonder how LE got from a burned out light bulb to all of the other charges. My conspiracy theory nose smells a setup.

I agree with gigag. This is as good of a test case as any to go up through the courts. I hope that someone will help the victim do just that.

UPDATE
District Attorney Paul Czajka dropped a state SAFE Act charge Thursday in county district court against Hopewell Junction resident Gregory Dean Jr., who was the first person charged in the county under the controversal law since it was enacted last month.
Looks there is someone with common sense in NY.

I have not seen any action by NY legislators that exempts LEO's from the limit. So...........Since the PO's that arrested him were most likely in violation themselves maybe a smart DA wouldn't want explain how that can be.
