Suicide by cop? or mentally ill?
Reading this story:
A guy messing with a toy rifle at Walmart was killed by the Police. Another customer, a lady, freaked out and died while fleeing the scene.

Either way he had some form of mental illness. Something was definitely not quite right there.

What a tragic situation.
What is unusual in this incident, besides the obviously disturbed individual, was that after the initial volley of shots knocked the BG down, instead of shooting him again as he tried to get back up, an officer de-escalated the force continuum by using physical force, tackling the BG, instead of just shooting the BG again. Kudos to that officer!

We had a mentally impaired individual in my hometown nicknamed 'Tex'. Tex ran around town in a cowboy hat with a bandanna and semi-realistic toy six-shooters with a leather belt on his waist. Everyone in town knew him and that he was harmless and just loved western movies and playing cowboy. His mental level was that of a not to smart 7 year old, even though he was in his 40's (best guess). Tex would periodically disappear for a few months at a time and we figured he must be back doing time at the state mental hospital, usually voluntarily admitting himself.
We had a new officer that had been hired from another city. One Saturday afternoon he frantically radioed in that an individual armed with two cowboy type guns was waving them around outside the bank and had gone inside. Before he unkeyed the mic he said to to send backup and he was going in. He jumped out of the car before anyone could radio back that it was probably Tex and to give us a description. He entered the bank with gun drawn and yelled for Tex to drop his guns. Luckily one of the loan officers was at a desk between Tex and the responding officer and the loan officer quickly intervened and told the police officer there was no issue and that Tex was only there to get a lollipop from one of the tellers. We had forgotten to tell him about some of the 'locals' that were a bit on the unique side. That became a standard policy from that point on to educate the new officers about those in town who were a little 'different' but basically harmless.
Tex could have easily ended up like this guy. Today he probably would have if it wasn't a smaller town and everyone knew everyone else.

This is from KJAS in Jasper, Texas, no one was hurt but it could have been turned into a deadly situation.
Officer Lawson Dry’s report said it happened early Saturday afternoon when 21-year-old Andrew William Weinzierl, of Cleveland, Ohio, was detained by store security after he allegedly took an air-pistol out of its package, and then tried to load .22 caliber bullets in it.

This is getting a lot more conversation on the Ohio Concealed Carry forums, with the usual contingent of people who distrust any time a policeman shoots at anyone. They are arguing with the people who point out the wisdom of dropping whatever is in your hands when ordered to do so by a policeman pointing a gun at you.
In Dayton (this occurred in a Dayton suburb), the usual rait-baiters are now pointing out that the man waving this around was black and apparently the police officers were not. They have decided to gather in front of Walmart in the usual "Occupy Whatever" protest.
Meanwhile, we hear "bb-gun" and have a mental picture of one of those old lever action daisy rifles. Well, here is a picture of what he was waving around:
According to latest info from the AG's office, the rifle was a Crosman MK-177. Here's a pic:
Meanwhile, the local police have already announced they are turning the death investigation over to the state bureau, where it will be thoroughly investigated in a professional manner.
Me? I am left thinking of the old saying, "You can't fix stupid".

There is a back story to this.
Toby Hoover is a long-time anti-gun zealot who has fronted the Joyce Foundation-funded Ohio Coalition Against Gun Violence for years.
She is on record multiple times encouraging people to call 911 every time they spot someone with a gun and accuse the gunowner of threatening people. If that is what this 911 caller did, there could be both criminal and civil implications.
There is Wal-mart store video available that has been reviewed by law enforcement and the Ohio Attorney General. The Ohio Attorney General has hinted that having to criminally charge the officer will make him very sad, implying there is no threat evident in the video.
There is no way I am going to assert any conclusion on anything until the evidence is in. How many times have we seen inaccurate or incomplete news stories?
