ACTION ITEM: REPEAL OF THE FEDERAL GUN-FREE SCHOOL ZONE ACT INTRODUCED IN HOUSE!

This bill is more important than many of you may realize. Under the federal Gun-Free School Zone Act (GFSZA), if you are within 1,000 feet of a k-12 school and you are carrying a loaded gun without a CHP (openly or concealed), you can be charged with a FELONY. If you have a CHP, you are golden as far as the feds are concerned - you can carry into a classroom of a K-12 school under federal law (NOTE: It is Virginia law that makes doing so by a CHP holder or anyone else a FELONY).

For those of you with CHPs that are feeling a little smug right about now, here is another dose of reality: if the CHP you have is not issued from the state where the school is, YOU ARE NOT EXEMPT! So, if you are visiting, say, North Carolina and are carrying with your Virginia CHP, if you are within 1,000 feet of a school you could get into serious legal trouble.

In Arizona the BATFE has been doing some saber rattling over the GFSZA, handing out pamphlets telling gun dealers that customer leaving their stores should have their guns unloaded and locked in a case or face possible federal prosecution if they pass within 1,000 feet of a school!

So, as you can see, the GFSZA MUST GO. VCDL has been working on this quietly for some time with some other gun groups from across the country. Board member John Fenter has been heading the effort for VCDL.

The good news is that Congressman Ron Paul has just introduced a bill, HR 2613, to completely repeal the GFSZA!

Email your representatives and send them the suggested email below, possibly modified as as you see fit:

For "Subject, " I would select "Other" or, if available, "Gun Control"

Suggested message:

As a constituent, I urge you to co-sponsor HR 2613, Congressman Ron Paul's bill to repeal the federal Gun Free School Zones Act. The current law makes schools more dangerous because only good people obey the law, so criminals can carry guns on school grounds while everyone else is left totally helpless. Worse, the Gun Free School Zones Act puts innocent gun owners at risk of a FELONY charge for simply passing within 1,000 feet of a school, something that it is virtually impossible to avoid when traveling!

Please let me know what you are going to do.

Does anyone have a better way to email members of congress than using the congressional web page?
It's such a pain to use...

If I reply to the emails I get from my Rep, it's a dead end mailbox used for outbound mail only...

And.... Good on Ron Paul for this bill...
He's got two things right this week, the other being not raising the debt ceiling.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘Citizens Protection Act of 2011’.

SEC. 2. REPEAL OF THE GUN-FREE SCHOOL ZONES ACT OF 1990 AND AMENDMENTS TO THAT ACT.

(a) In General- Section 922 of title 18, United States Code, is amended by striking subsection (q).

(b) Related Amendments-

(1) Section 921(a) of such title is amended by striking paragraphs (25) through (27) and redesignating paragraphs (28), (29), and (32) through (35) as paragraphs (25) through (30), respectively.

(2) Section 924(a) of such title is amended--

(A) in paragraph (1)(B), by striking ‘(k), or (q)’ and inserting ‘or (k)’; and

(B) by striking paragraph (4) and redesignating paragraphs (5) through (7) as paragraphs (4) through (6), respectively.

(3) The Gun-Free School Zones Act of 1990 (18 U.S.C. 921 note, 922 note; section 1702 of Public Law 101-647; 104 Stat. 4844-4845) is repealed.

Yes, one or two of us have heard of the GFSZA.

FAQ: Gun Free School Zone Act

Repealing it would be a good thing, it is a bad law and has the potential to catch an othewise law-abiding but unaware citizen. But as a practical matter, I am doubtful that it is something that we should spend a lot of political BTUs on right now. In the vast majority of prosecutions under this act that I have looked up, violations of the GFSZA have been add-ons when someone was arrested for something else (e.g. illegal drug activity) and he was discovered to also be carrying a gun and happened to be within 1000' of a school.

If it can be passed without much effort (which I highly doubt) or tacked on to something else that's going to pass no matter what (like carrying guns in national parks was added to the credit card bill) then fine, but real political effort should go towards expanding gun rights on a broader scale legislatively and judically, and reigning in the BATFE, DOJ, etc.
