My baton is not meant to "damage" or "kill," but it is very good for using against "meaty" targets, such as the thighs, biceps, calves, etc. It's not going to kill somebody, but an instant charlie horse to the thigh may get compliance through pain and discomfort. I would not exactly call it a tool of self defense.
Expandable Batons are also a pretty good fear compliant device. For some reason they scare the crap out of people. But the average asp hit across a muscle group doesn't cause enough trauma to cause a muscle spasm. A baton that is that heavy, that can be swung with enough force, is also a weapon that has a much greater chance of greater injury when used. everything is a trade off.

For the most part this is by design as the older leaded wood batons can cause real physical damage and death at a much higher rate than modern batons.

I wouldn't worry about it. They will only charge you with an illegal weapon if there are other charges. Basically if you just use it as a walking stick you are fine. If you use it in a clear cut case of self defense you are fine. If you use it against a neighbor and you get charged with assault then you might have them pile an extra charge on but it would only matter if you don't beat the assault charge anyway so switching to a gun would of just gotten you more charges most likely.

many residents in my area walk with a club, cane, stick, or golf club. This is against Texas law, but it seems to be tolerated by the police for walkers not wishing to be chewed on by pit bulls.

Lots of items are not considered clubs unless or until they are used as such. A stick used to run off dogs would be fine, the same stick used against a person is a violation.
