Re: Woman faces life in prison for trying to save baby ducks

She certainly used poor judgement, but I believe there was fault on both sides. You should (almost) always drive at a speed that you can stop for blockage already (not something darting out) in your lane. Slow down to be able to do so. She should be penalized, but not imprisoned. Her mistake, thoug...

Re: Is it legal to carry a collapsible baton in texas?

Not trying to sharpshoot the law, BUT 46.02 makes it illegal to carry a handgun, illegal knife or club . Then 46.15 says that 46.02 does not apply to someone who is carrying a handgun with a valid license. So it appears that carrying a club is not illegal to a CHL holder with a gun based on 46.02. ...

Re: Is it legal to carry a collapsible baton in texas?

YMMV with different LEOs. I also have a collapsible steel baton and a few LEOs have seen it. I also have a big Bowie knife that I've had in my truck before and various LEOs have seen it and seen me use it. I use it around a campground for different things kind of like what a hatchet would be used f...

Re: Woman faces life in prison for trying to save baby ducks

If you are going too fast to stop for unexpected obstacles, I think you are driving too fast. Perhaps following to closely? Hiw do you know he wasn't 10 under the limit and there was no way to avoid? And, it is idiotic to stop in the middle of the road. Unless there is no choice it is at least negl...

Re: Woman faces life in prison for trying to save baby ducks

In most cases here, if you rear end another vehicle, you are at fault. Granted what she did was not real bright, but the biker should have been paying more attention IMHO. And I am a motorcyclist as well. that entirely depends on the circumstances. Do you have access to a police report, diagram or ...

It is optional but used, what makes you think it isn't? According to multiple supervisors I have spoken to overseeing the NICS program, the SS# is not used in the proceed, delay, or deny NICS procedure. If you have information otherwise I would love to see it. According to Attorney & Author Cin...

We were ALSO not authorized to check whether a firearm was unloaded at the ticket counter, that was up to the ticket agents and airline employees and if the airline wants you to demonstrate that the firearm is unloaded, they have the right to do so, and if you refuse, they also have the right to de...

Re: Carry in restaurant with bar...

Is there a law that specifically deals with carrying in a restaurant like Texas Roadhouse or other restaurant that has a bar but derives less than 51% of its income from the sale of alcohol? I know we can. But does that come from a specific law I've missed or from 42.035b1 only? ie...since 42.035b1...

Re: Carrying At Home

i suppose but whats thought provoking for me is if something did happen like someone breaking down the door and the firearm was used how would the factor of sobriety play in? would it still be just as cut and dry as you being sober and shooting someone breaking into your home? or not? This is not a...

Re: Deadline for class

I don't understand the argument. The fact is DPS will process applications for renewal up to 1 year after expiration. In 2009 DPS became required, under law, to issue private security registrations with a photo of the registrant already attached. They didn't do it until last year.... All of the argu...
