Hopefully it will be taken up again in the upcoming legislative session.PriestTheRunner wrote: ↑Wed Oct 03, 2018 3:15 pmI would love to see a bill pass that the clerks must allow for electronic access to the documents and waive a fee. Then they simply point in the direction of the online documents. The bill should leave a fee for costs incurred for paper documents, though IMO.dlh wrote: ↑Wed Oct 03, 2018 2:36 pm Here is a link to the electronic docket sheet. Does not appear there is any recent action so I presume the matter is pending.
Too bad we cannot obtain copies of the linked documents for free. There was a proposal to do that the last legislative session but the clerks' offices opposed it because they did not want to lose the income they receive when they charge for it.

Technology is there and at this point is doing nothing but getting cheaper. A centralized state system could consolidate the cost of the servers and maintenance, and rulings would simply need to be uploaded once by the clerks and be publicly accessible forever. Make it a stand-alone system and you don't have to worry (as much) about hacking because there is nothing to steal.

Good to hear,Charles! I thought that was a frivolous suit from the get-go.Charles L. Cotton wrote:The Houston 1st Court of Appeals also ordered the trial court to conduct a hearing to determine the attorney fees and other costs of litigation the county must pay to Terry. The opinion makes it clear the court better award the money, or the appellate court will.
It was a great result. I'm going to do a podcast on this case pointing out the absurdity of the suit that was filed by the county and the judicial abuse by the judge who ruled in the county's favor.
Chas.

Re: Texas Carry Executive Director sued for filing signage complaint against Waller County
The lion's share of a State District Judge's salary is paid by the State of Texas. Local counties can supplement that salary but I am not familiar with how that works.
State District Judges in Texas are also elected and can be voted out of office by voters in their Districts.
I have no idea about the biases of the local District Judge who will hear this case. Will certainly keep track of this case.

District Attorneys and Commissioners are elected in Texas. Hopefully the voters will give them the toss next time they are up for re-election.

Wow! Just wow! Outrageous to bring a private party into a lawsuit like this. You can blame a misguided District Attorney and an equally misguided commissioner's court.
Hopefully his lawyer will soon file a motion for summary judgment and get him deleted from the suit. Would love to see attorney's fees and costs assessed against Waller County for trying to flagrantly chill a citizen's right to file a complaint.
