If you were going to charge him at all not knowing any more details than were released in the initial news stories it would seem much more appropriate to me to charge him under 19.05 with "Criminally Negligent Homicide".Charles L. There was absolutely no intent on his part but he did not take ordinary care to ensure the gun was unloaded and unable to fire as I read it which was the proximate cause of death.
His life is already ruined, what is the point of overcharging him?
