The President announced the appointment of the following conferees on the part
of the Senate:Senators Hegar, Chair; Birdwell, Whitmire, Wentworth, and Patrick
That's very good for us, albeit larger than expected. I trust the House conferees will be equally as good Mr. Speaker.

The deadline for the House to pass House bills is Thursday at midnight, so the Calendars Committee is pushing House bills onto the Calendar. After Thursday, Senate bills will be set, including SB321.

Chas.

Pardon my ignorance, but does that mean this is dead, Thursday would have been 5/12?

thanks

Bill
No, the deadline was for the House to pass House bills. It can still pass Senate bills.

BillC wrote:I am still a little puzzled on the status of this. Is it a done deal and waiting on formalities or is there a chance it can be pigeonholed somewhere and die?

Bill
Yes, it could die if 1) a conference committee isn't appointed; 2) the committee fails to reach a compromise; 3) the committee reaches a compromise and either the House or Senate fails to pass the compromise bill; or 4) Governor Perry vetoes the Bill.

None of these are at all likely.

What is your take on the Hartnett amendment?
If it is the same as the copy I was provided earlier, it is of no consequence. All it does is clarify that the civil immunity granted to the employer and it's agents does not extend to any person who actually caused injury or damage with a firearm, or to the employee who brought the firearm to the parking lot, if he/she didn't lock it in their car.

Re: HB681/SB321 Parking Lots Bill is on the Floor

It looks like people (opponents?) are going to offer amendments even on third reading. This should be a formality, but I guess opponents aren't going to give up even facing a 100 vote majority.

Here is what I posted yesterday.

Charles L. Cotton wrote:SB321 passed to third reading tomorrow and that's a formality. Then the Senate will either concur with the two amendments Rep. Kleinschmidt put on the bill, or refuse to concur and the Bill will go to a Senate/House conference committee. From there a compromise would be presented to both the House and Senate for an up or down vote with no opportunity to amend.

Coogan wrote:Does anyone know what Amendment 4 to SB 321 was about? I know it was tabled, but the vote was close.
The primary thing it would have done is grant additional immunity to employers even for gross negligence, as long as the case wasn't based upon the death of an employee due to gross negligence. I had other language, but the goal was additional immunity.

The employer would have to tell employees not to carry on Farmer Brown's property.

rbftfire wrote:Now here's the big question that I have, how does one go about determining if the property is subject to a valid gas, oil, or mineral lease? And if it is, how do we obtain the terms to see if firearms are prohibited?
If you mean as an employee, you do not have a right to review a contract to which you are not a party.

Re: HB681/SB321 Parking Lots Bill is on the Floor

Liberty wrote:What are amendments 1 and 2 ?
One adopted what I call the "Farmer Brown" exemption that allows employers to prevent employees from taking firearms onto Farmer Brown's property to drill or maintain an oil or gas well, if the mineral lease contract requires that no firearms be brought onto the property. The second amendment removed an effective date that would only apply the Farmer Brown exception to leases signed prior to Sept. 1, 2011.
