Do the civil rights suit have a punishment phase? Could someone go to jail? I guess, any corrective measures can be in the included in the settlement.

One has to ask, did Erik commit a felony in the store so 911 was summoned? was it a misdonomener? or no crime at all? He was evacuated like everyone else where was the threat that drawn guns were needed? Least to say there was poor response to this incident. Such scenarios should have been studied, trained for, etc.. I do not hold hope for anything more than justifiable.

I agree. However, due to the state of mind of Erick and hi-dose of depressant in his system, I would assume Erick did not react like a normal person. Wow imagine if there was a real video that clearly captured the incident. Imagine that such video shows up in court. Are those who testified would be proven to lie under oath?

Then, the evidence is clear, the officer overreacted and shot Erik when he was disarming himself. Any one asked the officer how one is supposed to disarm himself? he claimed never tested the theory because he is not an idiot and any LEO knows that one of the functions of the holsters is to not to allow any access to the trigger and render the holstered firearm harmless.baldeagle wrote:Yes, the pistol was always holstered. Also, wasn't said in the 911 tapes that the subject pulled a gun, not pointed a gun. The gun was holstered, no? I believe the whole enchilada of the show is to cover the rear ends of all involved.

Did they testify that pistol was all the time holstered? If true, then there is no way the holstered pistol could be considered dangerous. No way you can discharge a pistol with holstered pistol pointed to the officers or otherwise. Also, anyone questioned whether the pistol was loaded, cocked and ready to fire? was the safety on?

It seems that prosecutor are painting this incident as a suicide by cop, or incoherent drugged and armed person who threatened the officers with deadly force. It is interesting to see what video evidence there is or was.

Will his girlfriend testify? I assume she was next to him. Even with no video her testimony is critical. If Scott never pulled his gun, then a big cover up is in process. And why in the world 3 officers had trained guns in a non-violent incident?

What are the odds that multiple cameras would fail at the same time? what are the odds that the recording system only failed at the time of shooting?
