9 th Anniversary of the Murder of Erik Scot by Las Vegas Police.

A coverup, missing video tape, police awards, a book, a movie and grieving parents follow after the death of a CHL , former Army Captain and West Point graduate, whose only mistake was letting part of his gun show at a Costco that had no sign preventing concealed carry.

Apparently the killing of Erik Scott has not gone away in the years since it happened.

In case you never new about this event:

A CHL holder and former West Point Graduate and former Captain in the Army was killed by police just outside the front doors at a Costco in Las Vegas Nevada as he walked out with his girlfriend. His gun had been spotted by security as he bent down to place water bottles in a back pack or something he was considering buying. (Nevada is an open carry state and there are no signs prohibiting guns in the Costco in Las Vegas) The security person told him guns were not allowed in the store, he apparently went all 2nd Amendment on the employee, rather than simply leaving. He apparently mentioned his service in the military in the exchange with the employee. The employee also never told him to leave the store. Instead he called 911 and essentially said they had a green beret going crazy in the store with a gun. The police responded in force to what they were lead to believe was a serious problem. After the police arrived they announced that the store had a bomb threat and asked everyone to leave. As Erik Scott and his girlfriend peaceably left with the other customers, the store employee pointed out Erik to the police officer who followed Erik out of the store. At this point as he exited the building with customers everywhere around him, the police officer drew his gun and shouted at Erik to freeze, two other officers who were facing him directly also drew their weapons and shouted other conflicting orders. Erik was holding his blackberry at the time. At this point Erik either, froze, raised his hands, attempted to raise his shirt to expose his weapon or drew on the three officers who had already pointed guns at him from three sides. One officer fired first directly into his chest, then the other officers fired, he was shot seven times, five times in his back while he was on the ground. All seven shots that were fired met their mark otherwise, the officers would have shot each other or would have hit the other customers who were exiting the store at the time. Customers who were interviewed, all had conflicting views of what happened. Some thought Erik went for a gun, some thought Erik did nothing, some thought the police just executed him.

The Costco has an extensive video system. Everyone on this forum felt that the video would clear up the confusion. We would later find out the video didn't exist as the system was not working that day for the cameras that would have recorded the event. The police did not take custody of the video computer system for days. The video DVR's were not sent to the FBI Computer Forensics Laboratory in LA, but were analyzed by Al's Computer and Video (or a name like that) in Las Vegas who had a contract for video services with the County.

A inquest was held. The family was not allowed to participate. The prosecution presented evidence that Erik had prescription drugs in his system and a former wife reported that he had struck her. The police officers who were involved said Erik had tried to go for his gun and they shot in self defense. He was carrying two guns at the time. One gun, he was not licensed to carry. (Nevada has weird CC laws as your license is tied to a specific gun) The shooting was ruled justified. The family sued the Police department and Costco, both suits were eventually dropped. The family had a reward out for video of the shooting, but no video has ever surfaced. They believed that the video showing the shooting did exist.

As time has gone by officers in the Police Department have apparently talked about seeing the missing video.

The man in Fort Worth who was in his garage and was shot by the police or the former Marine who was shot by police in his home in Arizona, still shows how dangerous it can be when you have a weapon and are surprised by the police.

Erik Scot's problem began when he accidentally exposed his weapon, had he not done that he would probably be alive today.

Yeah but did you know her name was Scott.

Can't find the article, but one commentator blamed police policy. If two officers are present. The other must draw his gun, per this commentator. Then if the Taser for some reason fails to work. Police policy prevents the other officer from holstering. Police have hands occupied with taser and a gun, have no choice but shooting.

There is a difference. But when your going to call the police to have some one arrested, you need to at least ask the person to leave.

Staying guns are not allowed in a store when there is no sign, sounds a lot like a security person over stepping his authority, this may have been how Erik felt. Who knows now as he is dead and the video evidence and other physical evidence was not collected or is missing.
Was it actually a security personal? I was under the impression that it was a stocker. If it was a stocker, I wouldn't heed the verbal notice of anyone I do not perceive to be in authority or acting with authority. Security personal I would.
A lot of time has passed, but the security person may have been just normally dressed and may have not identified himself as "loss prevention" which is what I think the guy actually was. Erik was reported to him by "an employee or customer" who may have seen him tearing up merchandise. (taking bottles out of cartons to see how many would fit in a back pack) No video or merchandise from this initial incident was collected or recovered. Funny how that never happens that way on CSI.

Companies are responsible for the actions of their employees.

I went to the Costco a few years ago when I was in Las Vegas. There are still no signs, saying guns are not allowed. I am a former member of Costco, I did not know of the no gun policy until this happened. Erik had just joined Costco a few moments before, I'm sure the attendant did not say "oh please read this fine print contract carefully. It says you can't bring a gun into the store."

Erik was never asked to leave the store. Instead of asking him to leave, they called 911 and essentially said a madman was inside their store with a gun, Help Help. Then they pointed him out to the police as he was peacefully exiting the store with his girlfriend, so he could be killed.

In case you have forgotten five of the seven bullets were in his back after he was lying on the ground. Someone here called it contagious fire.

The video wasn't working that day, but it was never sent to the FBI, so we really don't know.

Former West Point graduate. Former Army Captain. Top salesman for Medtronics. Nevada CHL holder. Caucasian, handsome, athletic, the exact opposite of the police officer who fired the first bullet. Erik was portrayed as a wife beater and prescription pill addict during the one sided inquest.

"Drop your gun," "freeze", "get on your knees" the police called out with guns drawn and pointed at him. The first bullet fired into his chest killed him almost instantly.

CSI has never interested me much since this happened.

The Las Vegas police have harassed his girlfriend and other supporters since the killing.

One of the police officers has since been arrested on an unrelated matter, the two others have received a national police award.

I thought we could not link to lvrj, or did they loose that one in the courts pretty bad?

Nothing good about this but the lesson to us all.

Concealed is concealed. Any issue, immediately leave. Confronted by police, flat palm hands go slowly in the air, despite what they may be shouting.

There is no video. According to police sources, the camera recorder malfunctioned.
And the video is thoroughly examined by the same company that has the police contract in Las Vegas.

Got to be tough for the family to do this considering all that went on, especially after the shooting.

I suspect the Scott family will not settle with the City of Las Vegas, but will have a trial. Then we have the Costco liability.
