My understanding is making these guns was and is legal. Just as slam fire shotguns and other homemade guns (assuming they are not full auto) is and has been legal. The issue at hand in the case was providing the data files to the public.

Selling them would require you to have all the requisite licenses, or be in tremendously hot water.
