***WALLER COUNTY LAWSUIT UPDATE***

Not surprising, Waller County is appealing the Appellate Court's ruling in Texas Carry's Executive Director Terry Holcomb's favor to the Texas Supreme Court. Their objection is to having to pay attorney fees and being sanctioned.

Why are we not surprised that Waller County believes it is above the law and should not have to answer for its egregious lawlessness? They sued Terry Holcomb for exercising his constitutional right to redress grievances against government and exercising his constitutional right. He also exercised his right under established Texas law. It does not surprise us at all that they think they are above the law. They have shown contempt for the Texas Constitution, the laws of our lands and our basic inalienable rights. Not wanting to be held accountable is par for the course for them.

There is, however, a benefit the citizens of Texas will get.

"While this only serves to show just how lawless Waller County behaves, it is really something we are glad to see. The possibility we may have the full Texas Supreme Court review this case is a good thing. If they agree to hear this case, their decision will become precedent for the entire State and not only a certain portion of the State that the Appellate Court has jurisdiction over. All of Texas citizens will enjoy the protections of the Appellate Court ruling, which I prefer. I welcome this next challenge posed by a terribly tyrannical Waller County Government, that thought it would be a good idea to sue a citizen for literally exercising a fundamental right to redress grievances with the government and operate within Texas law"; Terry Holcomb stated while adding; "I can not express enough how grateful I am to Edwin Walker with [Pre-paid legal service] for their amazing representation. They are more than up to the task and we look forward to the possibility to have the Texas Supreme Court taking this case."

While this will drag out for Mr. Holcomb and his family, he has shown he is willing to go the distance for our members and all Texas citizens. Waller County really should have done their homework before picking him to try an bully around.

Just wanted to bump this back up with some fantastic news!

Holcomb won on appeal, and Waller County's lawsuit against him for daring to complain about their signage was dismissed!

The lawsuit the AG has open against Waller County for their signage will now go forward.

I've already written a bill to "fix" the "fines for signs" law. Sovereign immunity has nothing to do with either "fines for signs" or the Holcomb lawsuit. I was asking about a bill to deal with lawsuits like the one filed against Holcomb.

Just got off the conference call, it did not go in Terry's favor at all but they kind of expected that given the good old boy system there.

They are working on the appeals already, and he said that several legislators called him to express concern. The legislators are working on a bill to prevent this kind of retaliation from happening again.

They absolutely do! I went to a town hall meeting they held in 2015 in prep for open carry... primarily for LEOs but open to the public. Quite a few officers and residents showed up. I was the only LTC instructor in the room. In reviewing the laws churches, hospitals and liquor stores were off limits... no sign needed. Several folks, including LEOs, questioned their interpretation. The only response we received was "in Waller County you'll be prosecuted".

Unbelievable. I would not have been able to keep my mouth shut and probably would have ended up getting kicked out of that meeting.

That's one of those things where you challenge it on purpose in order to force it into court just to spite the local law enforcement.

It did, but no official word yet on the outcome aside from the judge refusing Holcomb's request to dismiss the case based on first amendment grounds / Texas' Anti-SLAPP laws.

This Friday is the court case. Unfortunately I can't attend, however if anybody is in the area and wants to support the cause (and this should be EVERYONES cause), Mr. Holcomb is requesting folks fill the courtroom in support of the law and against county attempts at silencing dissent.

Looks like OCT is going to be staging a rally next Friday in front of the court house. This is getting interesting!

I'm not normally one for in-your-face tactics when it comes to legal/political matters, but what Mathis is trying to pull is chilling and a big threat to concealed and open carry alike. (in my opinion anyway)

11.01 Waller County prays for the following relief:
........
C. Court costs and reasonable attorneys’ fees.
D All other relief to which Waller County is entitled.

Like I said, a county filing a lawsuit against an individual citizen for notifying them appropriately of invalid signage, let alone also asking for fees, is unbelievable.

I really hope the CHL community at large rallies against this ridiculousness, otherwise we are all in for a bad time as we fight for our rights to not be unlawfully excluded from tax payer bought-and-paid-for buildings!
