Re: Rule clarification please...

I preface this with this...if there is another section of code either in the CHL law or otherwise that disputes what Im about to say then notwithstanding..... Using the logic given, then any law or statement of affirmative code can be assumed to be a 'defense to prosecution'. ie If I go the speed li...

Re: Rule clarification please...

Thanks for the clarification. I will take issue with one point however. Paragraph (i) is a stand alone paragraph under section 46.035 and does not mention 'defense to prosecution' in the language. This is a conspicuous absense since other paragraphs do use that language. It seems as straight forward...

Rule clarification please...

Under 46.035 Unlawful Carrying... (i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06. b4, b5, b6, and c deal with hospitals, nursing homes, amusement parks, churches, and meetings of government entities. That seems to be clear...

Re: Is this permissible in a classroom setting?

I was thinking along the lines of gun related activities. You can take a gun to a sporting event where guns are used. I would think that an official training class for concealed handguns would qualify so that a gun could be displayed. For example, during the class I might teach the proper way to hol...

Re: Church/work carry

Lots of advise here. To me this is a simple matter of Christian integrity and honor. You are aware and informed that your employer requires that you do not carry your gun at work. Even if the state of Texas allowed you to YOU KNOW that your employer requires that you dont. If we check the OTHER empl...

Re: Is this permissible in a classroom setting?

I was speaking more in terms of legality. Is it permissible to have an exposed (non-concealed) handgun in a generic classroom when the purpose of the gun is to use as part of the chl or firearms class?

Liability Insurance for Instructors

Is it typical that CHL instructors carry liability or malpractice insurance to cover them against people taking them to court for responsibility for one of their past students using their gun in a injury or killing situation?

Is it really necessary?

Is this permissible in a classroom setting?

If I teach a chl class or an NRA class, let's say in a hotel conference room (and I have the hotel's permission, or any other suitable classroom) can I unconceal my handgun (unloaded) and use it for demonstration purposes during the class? In other words does your concealed handgun have to stay conc...

Re: 411.171 question

I thought that also, initially, and it may be true. For example, what is actually being taught by the DPS in instructor classes? etc tex They do not teach you to interpret the law, they teach you the intent of the statute as they see it. That is the piece that must be determined, what was the 'inte...

Re: 411.171 question

I thought that also, initially, and it may be true. I work in the aviation industry as an instructor pilot and air traffic control instructor and my job requires me to be an expert on several parts of Federal Aviation Regulations. Having been involved in many cases where legal action was taken conce...

411.171 question

Reference the definition of concealed handgun in paragraph (3)... First let's look at what it DOESN'T say... ...means a handgun, the presense of which is not discernible... Now, what it actually says... ...means a handgun, the presense of which is not OPENLY discernible... Why the adverb 'openly'. W...

Re: what is the point of this.....

The sign says 'Unliscenced Posession." Since there's no such thing as a liscence requirement to posess a firearm in the Stata of Texas, this sign is nonsense! My CHL is 'Liscenced Concealed Carry." The only thing I have for possessing the firearm is my receipt from where I purchased it. :banghead: ...

what is the point of this.....

You see these signs everywhere...usually at corner stores... 'The unlicsenced possession of a firearm on these premises is a felony and is punishable by up to 10 years in prison and a fine,,,; Why? Is it to remind us of the obvious? It implies that at other places without a similar sign that the unl...
