Re: 51% question

Sorry Picture above is from Stonwerks, 1604 and Blanco, San Antonio. Question. If the parking lot is included in the liquor license definition of "premises" for 51% establishments, why can't you buy liquor and take it out to the parking lot to drink? Also, what about parking lots used by ...

Re: CHL fatally shoots teenage burglary suspect

Not that I disagree with making the parents of scum-bag minors responsible for their actions, I do...but I don't think 17 is a minor in Texas. I believe you are an adult at 17 in the eyes of our state government. I think. I could be wrong, but I'm pretty sure. Well, actually, it kind of depends on ...

Re: 51% question

Thanks to all trying to channel me. You have done well. The answer does depend on what is on the TABC license. In the case of the bowling alley, it depends on if the bar is owned by the alley or a contracted business. If it is owned by the alley, then it is highly probable that the whole premises ar...

I can confirm that it is county owned. I stopped going after they gave it to the Spurs so I can't tell you if it is posted or not.

Re: Pro and Anti Op-Eds in the UT Austin Student Newspaper

Campuses do not need to be subject to gun violence By John O. Woods Daily Texan Guest Columnist Furthermore, violent crimes have been few and far between here at UT. There has not been a murder on campus in the past 10 years. There have been only three murders since 1980; two of those were apparent...

I love a story with a good ending. If only more companies would think about this.

Re: SC Rules 5-4 Illegaly obtained evidence OK

AFCop has the correct answer. If I am legally in a place I can be, anything I find can be used. This is the basis for the plain sight exception to the warrant, and it also applies to how warrants work. If I am searching according to a warrant, I can search places that the specified item could be in....

Re: LEO Duty to Notify

Excaliber covered the most important aspect of the question. Officers are not required to notify, but generally do as a courtesy. Some just ID themselves as officers and it can be assumed they are carrying from that (some ID themselves to say they are carrying and some do it to ask for a break but i...

Re: SC Rules 5-4 Illegaly obtained evidence OK

Actually, this is a long standing policy of the SCOTUS. It is the good faith exception to the exclusionary rule. Basically if the cop making the arrest had a valid reason to believe he was operating in accordance with the law, and he is operating on this belief in good faith that what he does is leg...

Interesting concept. I wonder how many people would remember to cycle an automatic TWICE before firing in an emergency, such as a break in at night.

I still prefer training and education myself.

5. In unusual situations (e.g., an extremely irate or irrational subject) the Officer may even deem it appropriate to place the weapon in the property room and complete a Information Report and property receipt, as long as the reason for safety concerns can be articulated. I would think that a pers...

Re: excellent stop by Fort Worth PD

The real reason an officer pushes his hand down ont he trunk is the old safety tactic of making sure the trunk is actually closed and no one is going to spring out at him after he goes by. Now that most new cars have the mafia trunk release inside, it doesn't make as much of a difference. And exhibi...

2. Possession of a Controlled Substance – Misdemeanor I received probation for both counts. I think you might have a problem but it would depend on exactly what substance you had. I don't know of any cases where this is still a misdemeanor and the CHL law says: (b) For the purposes of this section,...

Re: Sporting Event Question

But you do raise the interesting point of exactly what is a sport. I don't know of a definition in the law for it and unable in a quick search to find one. If the term is never defined in any code in Texas, then it would mean whatever is generally recognized as a sport. I found two different definit...

Re: When does 'verbal provoication' cross the line?

Well, I hate to disagree with so many of you, but there is an old AG opinion on verbal provocation justifying force. If you call someone a communist, he is allowed to punch you. Or so the AG said in a case involving Henry B. Gonzalez one night in the 90's. On a more serious note, the law does say ve...
