Re: Wanting advice on father's lax CC status
Kalipsocs, The thing you might do when talking to you father is give him some credit for being partially right. As a general rule, if something happens and he does need the weapon, Texas DA's and juries have traditionally looked more at the justification for the shooting than how the person happened...

Re: ID in the home...
The answer is really clear when you look at the exact wording of the law. You are required to show the CHL with the DL/ID when asked for it by a peace officer unless you do not have a gun with you. There is no limit to where or how the officer asks for the ID. The only part that is unclear is if you...

Re: Firemountain an amusement park ?
While the officer could ask your friend to leave, and it would be valid under 30.06, the officer was wrong on his logic. As posted, even an amusement park requires posted 30.06 signs to generally ban. But, and I am guessing here from a quick google search, if you mean Fire Mountain Amusements in Tyl...

Just wanted to correct the typo, since I would have pointed out the same thing.casingpoint wrote:The statute does not use the word replaced, nor does is equate replacement with recovery. The two are not the same.you would have to believe that the items in your wallet could not be replaced/recovered

Re: 9mm not adequate...?
I have carried and relied on smaller calibers than a 9mm in my time, and have carried a 9mm also. I have no doubt in my mind that a 9mm is quite satisfactory as a defense round. In addition to the military and NATO, there are quite a few police departments in the US and many in Europe that rely on t...

Re: What about reducing non-carry locations?
I didn't make my question clear enough in my post. 46.15(a)(5) exempts retired officers from the provisions in 46.02 and 46.03, but it's unclear to me if it also applies to 46.035 which applies to carry in bars, at sporting events, etc. Texas laws are written a little differently than what I'm used...

Re: previous record
Another reason they cannot look it up fromt here is that many counties are not very good about entering data. Many of the rural counties did not have computers until recently and many still do not have very good data entry departments. I seem to recall a recent newspaper article that said that only ...

Re: State of Texas as an Employer -Background Check ?
I think the point many are missing is who runs the DL check. Your CHL status will show up if the police run it, but not on a check from another agency for a background check. Consider that insurance companies run your DL's all the time for rating purposes. You can go order a DL check at DPS for the ...

Re: LaserGrips and concealment
I support the laser as a targeting device, both as a training aid and as a system to help ensure hits at a distance. I do not think that picking up the dot will be that hard or long in distance combat. But, I have to admit that I do not think it will help at all in very close range shooting. If you ...

Re: What's the proper way to load the +1?
Some people are not as concerned about one round as others are. I prefer to carry as full as I can, but I know many who do not even load their magazines fully. A long time ago, I was taught to never load a magazine fully because it could cause the spring to compress and set, losing some of its elast...

Re: What about reducing non-carry locations?
Suggestion: Include retired Texas, federal and out of state law enforcement officers who carry under LEOSA. This should not be controversial. Already included in 46.15(a)(5): an honorably retired peace officer or federal criminal investigator who holds a certificate of proficiency issued under Sect...

Charles,
If that bill gets introduced, let me know if there is anything I can do to help (like testimony from a Master Peace Officer that this is fair and would not cause a problem).

Re: Another Hypothetical
There are two sides of the question that must be considered. The first is the legal and the second is the tactical. On the legal side, I would think you were justified in shooting. As a police officer, I have always taught and been taught that if someone is attempting to get my firearm, it is becaus...

Re: My TABC Phone Call
I am glad to here you had a good experience calling TABC. I just wanted to correct one slightly incorrect statement. TABC does not just assume anything about any license application. The original application also listed what the expected sales would be and we decided the 51% rule based on that. The ...

Re: OC at Academy
I may be wrong, but I was told that OC was first developed by the Postal Service as a dog repellent for their carriers. It was only after it worked there that it expanded into the police and self defense markets. All OC is based on the same chemical, just in different strengths and with different ca...
