I think this is the same case.
In addition I believe Trump ordered that the Seals confinement be upgraded. I think this is also the same case.
I believe this all goes back to Obama’s rules of engagement.

In March, President Trump tweeted that he ordered him moved to less restrictive confinement. But it looks like his CO is defying his CIC and the Constitutional rights of the accused with regards to privileged communications with his attorneys:

NCIS investigator accused of misconduct in war crimes case.
Sounded like, let’s go after this guy, ignore any evidence that contradicts our goal, and hide it from the defense.
Funny when I did this search I figured there would be hundreds is articles about it. Instead nothing but “New Charges Against Seal Chief of Murdering Afghan Civilian”
To try and cover up this new accusation.
Apparently lots of witnesses is really one or two, both of whom he had disciplined before. Many other said they were coerced into saying things that were not true or did not say. All want immunity from prosecution, so they can tell the truth.

Judge has ordered Chief Gallagher released from pretrial custody due to misconduct of prosecutors. His attorneys have requested the case be dismissed due to the misconduct. The judge has not ruled on that motion yet. Trial is set for June 10th.
