Man came out Of his house through the garage to find a strange woman sitting on the steps. He went back inside and retrieved a handgun and when he came out again found another man Coming down the stairs from the room over the garage.
The male burglar was found with a garage door opener taken out of the homeowners jeep in the driveway.
Aggravated burglary charges filed against the couple. No indication of the homeowner refusing to speak to the police until he talked to his lawyer.

under Texas statute, wouldn't 'aggravated' imply that they were armed? But no mention of it in the article......
Or does the legal definition of 'aggravated' change from state to state?

Tennessee defines burglary as unlawfully entering a structure With an intent to commit a felony, Theft, or assault. Aggravated burglary is burglary of a habitation, defined as a structure designed or adapted to contain people overnight.
ETA: I just noticed that Tennessee also has the crime of “especially aggravated burglary.“ That’s when you cause serious bodily injury while committing aggravated burglary.
