If you read the story of the dismissal of the charges, you will find the word I most despise on the subject of firearms: "brandish". Some folks out on the interwebs like to bash on Texas' firearms laws, but at least we don't have to worry about that word or any of its derivatives. I despise that word because it has such a vague meaning that obviously can be twisted and misused so easily. Anyway, glad to see the charges against the couple were thrown out.

Yeah, Gardner is a well known liberal leftist. She prosecutes less than 25% of the cases brought to her by the police, and she released the looters and burners that were initially arrested back when the riots started. She described the McCloskey's actions as "a violent assault."

The St. Louis Police Officers Association, the union that represents the St. Louis city police, has labeled her policies a “criminal empowerment agenda.” Cripes, how does someone like that become a Circuit Attorney???

She is having her own problems with her bogus investigation of the previous Republican governor. She succeeded in getting him out of office which put the present Governor in place. The ex-FBI outside investigator she hired to investigate the previous governor is facing trial for six or seven counts of perjury based on his "work" on that case. The special prosecutor that indicted the investigator is still apparently investigating Gardner as well.

The most obvious answer to how she became a circuit attorney is organized crime. Organized crime gets one of their own in a key office, to cut their people loose after the police arrest them and lock up their adversaries. Organized crime's adversaries include both rival criminals and law abiding citizens protecting their property.

It would be accurate to categorize the government of the city of St. Louis as organized crime, run by the local Democrats

Sometimes it takes involvement by the U.S. Attorney's office, ala NYC mob circa 1970s-1980s.

Missouri does use the term in some of the statues related to permitted concealed carry. However, what really constitutes brandishing is complex, and Texas law of ‘displaying in a threatening manner’ can be basically the same thing. George Soros funded the elections of far left "prosecutors" in major cities a across the country. Including Dallas and Houston, maybe San Antonio a d Austin too. Gardner's was one of those. These "prosecutors" have done tremendous damage across the country.

Will the judge in St Louis refuse to drop the charges, order a Amicus brief from someone else and take it to an appeals court twice?

I would take some council from what you stated because you have experience. It would seem to me, however, that since the phrase in Texas law is "displaying in a threatening manner", then the opposite can also be proven, such as "did NOT display in a threatening manner"/"displayed in a non-threatening manner". I simply find that the word "brandish" conjures up instantaneous mental images in people's minds when they hear it, since it gets used so often by news stories and the entertainment industry via police shows and legal dramas, and thus is open to wide interpretation, unless the laws of a particular jurisdiction more narrowly define the word.
