According to the woman this guy had earlier threatened to start a fire on her property. She, armed with a handgun, found him on her property with matches in his hand, marched him off the property and made him lie in the road until police or deputies arrived and arrested him.

That wasn't the first time he had been told to get on the ground...notice how he crossed his ankles and put hands spread out above his head without being told?

Legal question....could arson of an inhabited area be considered attempted murder and meet with lethal force?

I dunno about Oregon. Texas law allows, in "protection of property," use of deadly force to prevent imminent commission of arson, and arson of an habitable structure or place of assembly or worship looks to be a first degree felony. Second degree otherwise.
