2017 Legislative Priorities

Things I wish to see:

License Holders able to carry anywhere police can carry.

If that doesn't go through:
remove all power from TABC in regards to firearms - blue and red signs have no more legal weight.
Change "shoulder or belt holster" to "holster".
Class A misdemeanor if someone without authority posts 30.06 or 30.07 signs (MDA).
The Attorney General has 60 days to rule on 30.06 infractions.
30.07 added to fines for signs law.
Remove section from 46.035 that gives special rights to churches, amusement parks and hospitals (currently still get a class A for walking past legal sign)
Remove professional sporting events.
Clarify what a school is.
Holsters don't have to be on your person (steering column holster).
Constitutional Carry.

EDIT 2/25/16:
Things also stated in this thread:
Locations that take in any public funds (stadiums, hospitals etc.) are not enforceable, even if technically privately owned.
Licensed Carry in Schools allowed (this is better than defining a school! IMO).
Courtrooms are only off limits while court in session (court offices not off limits).
Allow carry in polling places and racetracks (why banned in the first place, especially racetracks?).
Any business that posts 30.06/30.07 is liable for damages in case of assault/theft/etc.

EDIT 5/5/16:
Businesses/properties have to apply with DPS for 30.06/30.07 signs that have some sort of official seal on them and the address for which they apply. In this manner, private property applies/gets signs easily if they wish, but signs that are intended to go on public property, especially for temporary events, would not be granted.

EDIT 9/7/2016:
These ideas are added because of the AG opinion that gov'ts can't be held accountable for signs on their property that is posted by the private entity running their business or event on that property, and for the problem with the severe time delay for the fines for signs law.
Hold private entities accountable for posting unenforceable signs on government owned property.
Hold officials personally accountable for unenforceable/illegal 30.06/30.07/verbal notices on public property. We have already seen on numerous occasions that government officials have no problem spending tax dollars to keep their signs up.
Any license holder who is carrying and denied entry onto public property for an event will be owed money in damages from the gov't/institution who is refusing him entry.
Remove everything about amusement parks, hospitals/nursing homes, and churches/synagogues from 46.035.

We really could use some clarification on whether Jerry World (and other city-owned event venues) can prohibit licensees during events other than those already prohibited by statute. And if not, some teeth would be appreciated. :mrgreen:

Ex: Concerts at Cowboy Stadium (aka AT&T Stadium)

+1 for the reintroduction of HB 308 from the last legislative session.

Statutory spanish wording on 30.06 and 30.07 signs. Makes every single current sign null and void, unless it happens to have the exact translation already (fat chance).

Why sixty days? Why not 30 days? Why not 10? When we citizens are given notice we must comply immediately or suffer the consequences. They know the law. The AG should be all over this.

Change 46.03 and 46.035 to only include:

courtrooms while court is in session (Notice that "Court offices" is not included, not court houses... just the court rooms)
Secured area of an airport (duh)
Inside of correctional facility (Parking lot ok, put that in the statute)

Specifically eliminate:

1. Schools (We are statistically more law abiding than the cops that roam the halls of the local elementary school, so why not? Also eliminates the "We are a school/daycare" zoo folks.
2. Polling places (No voter intimidation has happened by armed men on "our side", no reason to believe that it will start)
3. Racetracks (This one was stupid to begin with)
4. Bars - it is already illegal to be intoxicated and carry, so why not allow the designated driver to be armed?

Also make a provision addition to the "No political subdivision may post signs" to include any place that takes public money. This would include any school, any partially city owned facility (Think Jerry world, convention centers) and any hospital, clinic, or doctor office that accepts medicare, medicaid, or even tax-subsidized Obamacare plans.

The liberals will be up in arms, and all we have to do is hammer the fact that police are able to carry in all of these places and that LTCers are more law abiding than the police. They will respond with "the police are better trained than LTCers" and all that we have to do is retort "apparently LTCers are better trained in obeying the law." Always being careful that we do not disparage law enforcement, simply make the point that we are as equally trustworthy to carry a gun in public and not harm innocent people as they are.

Make any place that posts a 30.06/07 sign statutorily civilly liable for any and all injury resulting from an unlawful assault on their posted premises. Make them put their money where their irrational fear is.

Removing force of law of a 30.06 sign at a location which is open to the public.

+1 for removing TABC 51% Red sign locations. Not all of which are bars. Not everyone there would even be there to drink. Example: Moody Theater and Long Center in Austin. Those places contract our their food & beverage sales which makes the whole premise off-limits currently.

While it may not happen in 1 session, every session should work towards this end goal by whittling something away.

I especially agree with these points Sully.

Anygun, I fully agree with your statement about being much less than 60 days, but what would the legislature approve? 10 days is probably not very "reasonable" to them.


I can update my OP with other good ideas so they are all on the first page.

Anywhere police can carry, second (or third, whatever we're up to). At least steps toward this.

Top priority - Remove all unnecessary and dangerous off-limits areas for LTCs. The only exception should be courtrooms when the LTC is a party or witness to an ongoing case.

Educational institution should be removed from the Penal Code. Only primary and secondary schools should be in §46.03 and LTCs should be excepted. Other clarifications should be made, but I won't put them in the open Forum for the dishonest opposition to see.
