Will I be eligible?

Hello Everyone,

When I was 15 in 1999 I was arrested and charged with burglary of a habitation(30.02(c)(2)). I was given pre-trial diversion and did 6 months of probation.

Will that automatically dis-qualify me even though I was a juvenile?

IANAL but i think if you committed an offense as a minor and you didnt actually go to juvy or anything i think it drops off your record when you turn 18. dont quote me on it tho. had a friend who was slapped with a criminal mischief charge when he was 16 and they told him when he turns 18 it'll disappear.

I think in the worst case scenario, you would be ineligible for 10 years, but you are well past that now.

Just be honest on your application and provide the necessary documents for how it was resolved and you should have no problems at all.

Even though you are beyond the 10 years and it was handled with a deferred adjudication/diversion program you must answer truthfully and provide same or it will certainly complicate your situation when it is discovered on the background check.

Legally you should be fine, just be honest and you'll have no worries.

You should have no trouble at all, just be sure to note it where they ask about prior offenses.

If you can, contact the probation office or court where it was adjudicated and get a copy of the final disposition to include in your packet.
