Stupid Signage Question

#1

Post by OneGun »

I was reviewing another gun forum, and there was a debate about Texas signage. The issue is the lack of clarity in the 30.05 signs.

My understanding is that as an LTC holder, the only signs that prevent me from entering and carrying are the 30.06 & 30.07 signs.

Am I correct?

However, because of the "substantially similar" problems with the 30.05 signs, the 30.05 signs do not always specify they are restricting "unlicensed" carrying.

So, am I subject to the 30.05 signs as well?

Texas Penal Code 30.05(f) clearly provides a defense to prosecution for LTC holders. https://statutes.capitol.texas.gov/docs ... /PE.30.htm
TPC 30.05 (f) It is a defense to prosecution under this section that:

(1) the basis on which entry on the property or land or in the building was forbidden is that entry with a handgun was forbidden; and

(2) the person was carrying:

(A) a license issued under Subchapter H, Chapter 411, Government Code, to carry a handgun; and

(B) a handgun:

(i) in a concealed manner; or

(ii) in a holster.

There are a couple problems with this chart. One is they switch 30.06 and 30.07 definitions when discussing concealed vs. open carry. Second is that in Federal facilities other than courts, carry is a federal misdemeanor, not felony.
