Secured area of airport

Secured area of airport
Ok, we know that if a license holder accidentally carries into the secured area of an airport he's given a chance to rectify his mistake. I've been asked by a retired LEO if there is any such exemption for them. Reading PC 46.03 I see nothing that would apply. Have I missed anything?

Concur LEOs are not mentioned in this law. Probably one of those things we need to tweak next session. That said, I cannot understand how a reasonable, armed individual could get as far as the TSA screening point and not know they were carrying. That said, I had a co-worker who accidently left a magazine in his carry on bag (no gun or ammo as it was all properly packaged in a locked hard sided container and declared in his checked bag). He was caught by TSA at the Norfolk, VA airport and you would have thought he was Osama bin Laden. End result for him was mag was confiscated and he got a nasty warning letter from TSA (this was 5 or 6 years ago).

I thought they were covered under LEOSA and able to carry into the secure area of an airport. They're not, really?

Nope. LEOSA covers violating of state and local laws only, not federal. Can't carry in post offices, military bases, airports, etc.

As a retired Delta Pilot, I can say that MANY people legally carry on the aircraft. Federal Officers can carry with no real reason. Thousands of Pilots are Federal Flight Deck Officers and carry their weapon when traveling as a passenger. Local LEO's can carry when "there is a need from the time the Officer could check the weapon until the time they could retrieve the weapon from checked baggage"....example, a LEO escorting a prisoner, a LEO that is traveling to pick up a prisoner who is waiting at the arrival airport. There were times I questioned local LEOs about their need to be armed. They all had good reasons. All armed personnel are aware of other armed persons on the aircraft. Local/State LEO's have a short course they take to make them qualified to carry if they have a need. I was a FFDO so I had to inform the Captain that I was armed if I was flying as a passenger and I was informed if other passengers were also armed. The crew knows who the Federal Air Marshalls are and we have a face to face brief with at least one of them. I carried an entire class of new Secret Service agents on my flight. I think we had 38 armed personnel on the aircraft.

Interesting. I long for the day when I, a loyal law-abiding citizen, can carry my sidearm anywhere I choose without question by TSA or anyone else.

Not true. I've accidently carried, on my person, out of DFW on a flight to COS. Never even thought about it until I sat down on the plane itself.

This brings up a question as to how a LTC can have a state law protection against prosecution for mistakenly carrying in violation of federal law. I think the answer is, they can’t. With for carrying in the secure area of an airport is a state law charge. The relevant federal law really doesn’t come into play unless you actually carry on to the aircraft, or if you attempt to evade screening.
