The wife and I are thinking of going to the Clay Walker concert there tonight. I'm trying to figure out if I can carry before walking up to the front door to find out.

IIRC, Billy Bobs is an "entertainment center" that has a restuarant and a rodeo arena and a dance hall. The entertainers performed in the dance hall. And the dance hall served alcohol. I wouldn't think of carrying in there. But the last time I was there was 1982.

The only way any of that would apply to CHLs is while the rodeo arena is the site of a professional sporting event.

"Entertainment centers" are not off limits. Nor are restaurants, nor dance halls, nor places that serve alcohol (under the 51% limit).

I don't think that Billy Bobs is considered a family enterainment place. I used the term "entertainment center" tongue in cheek and for lack of a better term. To be blunt, the dance hall portion is a honky tonk. I'm sure it's posted with the 51% sign.

Billy Bobs selling point was you could go to the rodeo, and then go around the corner and be at the dance. They also brought in good C&W entertainment for the dances.

But like I said, that was back in '82.

This is a point of frequent misunderstanding. The CHL packet includes this in the FAQ section:

Q: Can I carry a handgun if I am drinking alcohol?
A: No; it is illegal to carry a handgun if you are intoxicated.

Notice that the question they answered is not the question that was asked.

PC 46.035 (Unlawfully Carrying a Weapon by a Concealed Handgun License holder) says:
(d) A license holder commits an offense if, while intoxicated, the
license holder carries a handgun under the authority of Subchapter H,
Chapter 411, Government Code, regardless of whether the handgun is
concealed.

But, there is no definition for "intoxicated" in 46.035.

It's always inadvisable to drink and carry. But it's not necessarily illegal so long as you're not intoxicated.

I guarrantee you this... if you ever draw that weapon out in Billy Bobs, or any other place for that matter, or get caught simply carrying while your sucking on a long-neck beer bottle, I'd be willing to bet any officer will say youre intoxicated. The dont HAVE to prove it, they just have to suspect it and testify to their suspicion. Same for public intoxication. Suspicion alone is grounds for being jailed.

No, probable cause is grounds for being jailed, not mere suspicion.

Can't define alcohol tolerance - ie 3 beers per person. I know some folks who are a danger to themselves when near stairs after just 3 beers. Forget driving or carrying a firearm.

Its a judgement call on the LEO's behalf, and I sure hope he can decide whether someone is impaired or not.

I have a cop friend who told if you have On beer you CAN NOT carry your fire arm with you. That there is a 0 tolerence level when it comes to handguns and any kind of alcohol.
