30.05 Law and No Sign

My fiancee and I are planning our wedding at the Dallas Arboretum. My question is, the ceremony rental contract has the following entry in the "Other" category along with about a dozen miscellaneous items like no gambling, no refunds for mechanical fountain malfunction and there's a hot air balloon prohibition.

"6) Carrying a firearm is prohibited. This includes persons licensed to carry a concealed handgun pursuant to state law. Carrying a firearm on DABS premises is a Class A Misdemeanor, punishable by up to one year in jail and a $40,000 fine: Texas Penal Code, Section 30.05. "

Is this legal? I do not believe so for several reasons.

1 - The statute is 30.06, not 30.05 (long gun restriction).
2 - The language is not even close to that of the actual 30.06 or 30.07 requirement.
3 - They have no signs of any type posted anywhere.
4 - It might be city or state property.

Can you guys help me determine if this is valid or not? I wanted to wear my pistol during our vows, but I don't want to end up in trouble.

30.05(f)
(f) It is a defense to prosecution under this section that:

(1) the basis on which entry on the property or land or in the building was forbidden is that entry with a handgun was forbidden; and

(2) the person was carrying:

(A) a license issued under Subchapter H, Chapter 411, Government Code, to carry a handgun; and

(B) a handgun:

(i) in a concealed manner; or

(ii) in a shoulder or belt holster.

You should check to see if there are any 30.06 signs posted. The wording does not come close to complying with TPC §30.06.

Texas3006 app shows no .06 or .07 signs at the location. Neither the general nor the wedding FAQ's say firearms are not permitted.

Perhaps they wrongly believe they are an educational organization like the zoo does.

I think you're fine. Look to see if 30.07 signs with valid wording are posted at every entrance. If not, you should be fine (I'm assuming you're OC'ing since you said it was for pictures). Personally, I wouldn't stress all that much about it. If you do happen to miss a sign, it's a $200 fine. You're better off spending that energy making sure you don't miss any speed limit signs on the way to the venue.

The Dallas zoo no longer believes they are an educational facility. They currently identify as an amusement park.

I wonder if I can self identify as a LEO when I visit there. That seems like less of a stretch than a zoo wanting to be an amusement park / school / whatever.

I was at the Arboretum a couple of months a go and carried. I saw no 06, 07 signs and I looked carefully, even inside around the main entrance. One of my friends (who happens to live in Tyler) went there a year or so ago, just after OC when into effect and there were signs then. He pursued it in management. It was my understanding that the signs came down after that.

It appears it's 100% owned by the city. cant legally post 30.06-07 signs anyway from my understanding.
