Why was this case even taken to the GJ?

I can't reading the case description on the article this guy should never have been arrested, much less at in jail for two mnths awaint a grand jury decision.

In short he goes over to pick his wife up from her girlfriends' home.

Nobody but the GFs husband is there and apparently some sort of altercation breaks out between them.

Guy retreats to his truck which is struck 13 times by both rifle and pistol bullets.

He pulls out an antique .22LR rifle with only one round in it, no more ammo even in the truck.

He fires one shot striking and killing his attacker.

Self defense doesn't get any more clear cut so what the heck is this DA thinking? The guy should have never even been arrested so this makes absolutely zero sense to me.
