Anyone work at Walmart stores and carry at work?

Post by x007x »

Just curious. If anyone carries at the walmart store while they work.. I'll get the official policy answer later this week and let you know too. I have a personal connection to Walmart Corporate. I am just wondering on your side if you carry.
Well, thanks everyone. Have a good new years.

The official policy is you cannot carry on the clock. Unless they changed something, they cannot even hire an off duty police officer if said is required to carry by police department regs.

It is expressly prohibited to have a weapon on your person while you are on the the clock. I also didn't feel real comfortable leaving it in the vehicle in the employee parking areas for 8 hours either. Those spots are the ones farthest from the doors and "cameras" and I got off at about 1 am. Make sure you can adequately secure the weapon in your vehicle. Lock box and cable etc. I no longer work there though.

So do you work at a Walmart store?

If you do:
Would you rather lose your job, your gun, or your life?
When I worked retail, I wore CCW Breakaways. I was never afraid of my gun being exposed.

Also if your car is broken into; walmart will not do anything. They will claim its not their responsibility.

I think I would still want to carry than leave it in the car to be stolen and used in a crime and be out $700. Also for my current job. I wear an ankle holster. Pockets are free, and no possible chance of it being seen.

Any update? I didn't think walmart allowed employees to carry, but I could be wrong. I know I hated having a walmart on my beat because their loss prevention, (unarmed) is very aggressive and you get stuck taking a lot of shop lifters off their hands. The LP people get assaulted all the time. Too me (true story) getting stabbed over a $5 shirt is not worth it, but hey they say it's now a aggravated robbery vs. shop lift. In Austin APD lost an officer last year because the shop lifter then pulled out a gun and shot him. The unarmed LP were studs and jumped the guy after taking gunfire themselves and took the gun. :thumbs2:

I just talked to them..They said "If you work for Walmart, you can't have a gun on the premises at all. That I should also check the Tx CHL laws to see if where we can carry." Remember they live in Ar, so not sure if the Tx laws of a CHL would exclude the Walmart rules.

So pretty much.. You need to ask that store directly in my opinion.

LC §52.061. RESTRICTION ON PROHIBITING EMPLOYEE ACCESS
TO OR STORAGE OF FIREARM OR AMMUNITION. A public or private
employer may not prohibit an employee who holds a l icense to carry a
concealed handgun under Subchapter H, Chapter 411, Government
Code, who otherwise lawfully possesses a firearm, or who lawfully
possesses ammunition from transporting or storing a firearm or
ammunition the employee is authorized by law to possess in a locked,
privately owned motor vehicle in a parking lot, parking garage, or other
parking area the employer provides for employees.
Sec. 52.062. EXCEPTIONS. (a) Section 52.061 does not:
(1) authorize a per son who holds a l icense to carry a c oncealed
handgun under Subchapter H, Chapter 411, Government Code, who
otherwise lawfully possesses a firearm, or who lawfully possesses
ammunition to possess a firearm or ammunition on any property where
the possession of a firearm or ammunition is prohibited by state or federal
law; or
(2) apply to:
(A) a vehicle owned or leased by a public or private employer and
used by an e mployee in the course and scope of the employee's
employment, unless the employee is required to transport or store a
firearm in the official discharge of the employee's duties;
(B) a school district;
(C) an open-enrollment charter school, as defined by Section
5.001, Education Code;
(D) a pr ivate school, as defined by Section 22.081, Education
Code;
(E) property owned or controlled by a per son, other than the
employer, that is subject to a valid, unexpired oil, gas, or other mineral
lease that contains a provision prohibiting the possession of firearms on
the property; or
(F) property owned or leased by a chemical manufacturer or oil and
gas refiner with an air authorization under Chapter 382, Health and Safety
Code, and on which the primary business conducted is the manufacture,
use, storage, or transportation of hazardous, combustible, or explosive
materials, except in regard to an employee who holds a license to carry a
concealed handgun under Subchapter H, Chapter 411, Government
Code, and who stores a firearm or ammunition the employee is authorized
by law to possess in a locked, privately owned motor vehicle in a parking
lot, parking garage, or other parking area the employer provides for
employees that is outside of a secured and restricted area:
(i) that contains the physical plant;
(ii) that is not open to the public; and
(iii) the ingress into which is constantly monitored by security
personnel.TEXAS CONCEALED HANDGUN LAWS 55
(b) Section 52.061 does not prohibit an employer from prohibiting an
employee who holds a license to carry a concealed handgun under
Subchapter H, Chapter 411, Government Code, or who otherwise lawfully
possesses a firearm, from possessing a firearm the employee is
otherwise authorized by law to possess on the premises of the employer's
business. In this subsection, “premises” has the meaning assigned by
Section 46.035(f)(3), Penal Code.

That is incorrect. They cannot regulate your carrying when off the clock, only while you are on. When you are off the clock and in the store you are a customer. That is any retail store, they only have a say if you do something against the store.

I worked at Wal-Mart in the early 90's.
I bounced a check at that store for about $30 (unknowingly i was low on funds!) and was reprimanded in my work file for it.

I believe one of the papers you sign during in processing has to do with, you will not carry a gun while at work.

Can you please cite the law that says an employer cannot fire an employee for their actions inside a company building if the employee is off the clock?

I'm not a lawyer and have not seen a law that says they can or cannot. If Walmart were to fire a person for carrying you can take them to court for violation of their policy, and collect unemployment while doing it. There are also other recorses available.
