NJ sues CA company over interstate commerce

State Attorney General Gurbir Grewal told reporters at a press conference on Friday that such “ghost gun” dealers exploit a “loophole” in state and federal firearms laws by selling “80 percent builds” — nearly complete firearms advertised with instructions on how to complete them.
The attorney general said some of the 15 other gun dealers who no longer ship to New Jersey advise their customers to change their delivery address, arguing gun dealers were not doing enough to make sure they weren’t running afoul of state law. Grewal declined to say whether his office was investigating other sellers.

The attorney general called on Congress to pass a federal ban on such weapon kits.

I have a question on this! If you mail a 30rd mag to a State that says they are illegal but it's legal in your State and legal to mail so Fed's aren't involved, the only person committing a "crime" is the one taking possession of it, Right??? Same as this story how can NJ sue California for something that is only illegal in NJ?

I'm guessing that they're asserting the shipper KNEW it was illegal in NJ, and that shipping anyway constituted conspiracy?

The lawsuit accuses the company of violating New Jersey’s Consumer Fraud Act by failing to inform customers many of their products are illegal in the Garden State.

So your required to KNOW the laws of the State your shipping to? That's a big burden to bear!

While I whole heartily agree with you.... The ol' "Ignorance of the law is not an excuse" thing may be argued by the courts....

How can I commit a crime in New Jersey if I never set foot in New Jersey? How can New Jersey claim jurisdiction over a California company that follows (a) California law and (b) Federal laws regarding interstate commerce? :headscratch

There are many things illegal in many states. Naughty naughty toys and “naughty how to” books come to mind...
