I don't think it was ever taken away. It was never made illegal. That thought is why I started the post on the Texas Constitution and the carpetbagger language.
MOst states made concealed carry illegal. SCOTUS ruled a long time ago that concealed carry is not protected. I think the ruling would have to go that OC is protected.
That is where we need to focus some energy, IMHO.

Too many people want to tinker with the Code, to fine-tune it for every possible situation. That's not the solution.
The solution is to slash massive sections of code. Instead of adding exceptions to the prohibitions, start eliminating prohibitions. I'd start with eliminating Chapter 46.
As for worries about 30.06 or other bans, the solution is once again a simple one: reduce the penalties to the point that violations meaningless. If they get told to leave, they should leave; if not, they should get a ticket and be escorted out. No loss of license, no Class A penalties.
I am a strong supporter of private property rights, to the point that I oppose "parking lot bills", and I even believe business owners should be free to discriminate against anyone they don't want in their business (including those who are carrying guns). The problem is that under Chapter 36, trespassing while carrying any kind of "deadly weapon" has greatly enhanced penalties, and for licensed individuals the consequences go beyond the criminal penalties.
Solution: reduce the penalties. It works just fine in other states, where "no guns" signs are of no more importance than "shirt and shoes required" signs.

Kevin...Yer wanting to tinker with it anyway...

That's cool...
If you're going to reduce the penalties, you might as well eliminate them, thus opening those doors of choice, right???
Squeezing the balloon at one end, might bring about the changes we want at the other end as well...Reducing or eliminating the penalties for the infractions we could be faced with now, and increasing the penalties, both financial and possible incarceration for entities that restrict "incorrectly" (i.e.: posting a 30.06 sign incorrectly in anyway shape or form) might prove to place the burn where it really needs to be...
And that is, not on us...
I've floated this idea in here before...

There is no such US Supreme Court case or decision.
Tomorrow's Heller is almost with any precedent -- although there is Miller and some other dicta mentions of the 2nd Amendment, there isn't anything that controls on the RKBA. Miller is defective -- this was always easy to see because it is used by both sides (no one can really say what Miller says with any certainty).

ACTUALLY I have. I strapped my 870 on my back and a buddy strapped his 243 on his back....we rode our Harleys through town and down the highway about 14mi to the range. NOT ONE PPROBLEM.....and we even passed a cop.
Oh yeah......when we were done at the range we rode the 14mi back to the house.
I also OC on a VERY regular basis in my front yard. Be it to just run out to the truck or mow the lawn. I have NOT had any problems doing so. Could people "think" I am LEO? Its possible. However< I really dont care what they think.....because I am LEGAL.

With this recent talk, I've been discussing with my wife the possibility of taking a rifle out to the gas station next time I have to fill up.
I picked the gas station because I was looking for something that is very public, but not enclosed (like a grocery store).
Then we had to decide which rifle to use. I thought, rather than an EBR, something like an M-1 Carbine would be perfect. I'm seriously thinking about it. If we do it, we'll take pictures.

And if I get arrested, then I guess we'll find out whether we really have the right to bear arms or not.
Anyway, we'll wait and see what the SCOTUS brings us regarding Heller tomorrow. Maybe we'll celebrate with a little long gun open carry tomorrow.

I say start small, I might tote around my little 10/22, so fun to shoot 500 rounds down range in one go and only burn 10 or so bucks!

Where I'd really like to see the concealed carry law extended to is other weapons. I believe that in Kentucky if you have a CHL you can also carry a swordcane, big ol' Bowie knife, or other types of weapons that may be concealed. Texas trusts me to carry as many handguns and as much ammo as I can fit under my jacekt and into my pants, but doesn't trust me to carry a gentleman's swordcane or a knife with a blade longer than 5" or so.

I don't want to squeeze the balloon. I want to pop the PC Chapter 46 balloon, and let the air out of the PC Chapter 30 balloon until it's limp and wrinkled.
This is quite unlike the "tinkering" I mentioned, where more and more (hot) air gets added to every balloon.
Example: how many times a year do we have someone here on the forum insist that carrying in a hospital is illegal? The legislature didn't let that air out of the balloon, they just added more air (way down at the bottom) saying "But only if they post a 30.06 notice!"
The best way to improve laws is to cut verbiage, not add it.

So do I -- priorities are one thing, right and wrong another.
It is also possible we can achiever more sweeping reform all at once if we find the write leverage point and it is important that even as we accept infringements we do so KNOWINGLY and not gratefully.
That is referring to grateful to the GOVERNMENT -- it is fine to be (forever) grateful to someone like Rep Hupp and all the others in and out of government who pushed the CHL changes while still recognizing that even a CHL (requirement) is an infringement of rights.
It is one thing to want to see more changes in a certain order (presuming we can't have the all which should itself never be considered a given) and quite another to accept gun control and excuse it.
It is quite common for many of us (myself at times too) to presume that something like NICS/Brady background checks are "reasonable" when they simply are not.
