Typically, though, anyone who runs from the police would be charged with a felony charge of resisting arrest by flight or evasion.

Let me re-word it then. What would you say to the jury if you killed someone when your life was not in any danger? This would be analogous to a cop saying, "Stop, or I'll shoot." Whatever charge was pending against the deceased would be completely forgotten.
