I agree. Think of all the people who can't get a Form 4 signed by their local CLEO.

There is no reason you couldn't write a state law that says all sheriffs "shall issue" a Form 4 if the applicant satisfies certain criteria.

Once an application is terminated for "no response", the fee for that application is non-refundable & forfeited and the applicant will need to submit a new application & CHL-100 along with another fee.

The applicant is notified once, by mail, of a deficiency in their application process and given 90 days to rectify the problem. It is up to the student to keep track of their time frame. If they haven't received their license within 60 days, they really should start calling or going online to check the status of their application.

Lets say the same thing happened as described by the OP, with all the same rules we have now except the CHL is issued by the local sheriff instead of DPS.

The sheriff sends a letter. 90 days pass without a response. The application is terminated. A new fee is required to reapply. How is that any better than what happened with a centralized system?

Umm, does that mean the instructor can just issue another CHL-100 (with the original dates), or does the student have to re-qualify? I would think the instructor would be able to reissue as long as it's still within the 2-year limit.

I would strongly suggest this gentleman contact his local legislator and have them go up to bat for them. Especially if he believes he never received the notice (And given the DPS history of long delays) I believe he should be able to get his fee waived to reapply if he has a state representative or senator (or both) helping him out.

The instructor is required to keep a copy of all CHL-100s for three years. My guess is that making a copy of their stored copy would work.

It isn't a statutory requirement to terminate the process after 90 days, and it isn't a statutory requirement to send just one letter notifying. That is a bureaucratic rule.

There is nothing that says a local sheriff couldn't call you on the phone the next day and say "come pick your license up", or "hey, you forgot to include your proof of training".

Harris county, for example, has a little over 4 million people. If 2% had a CHL, that represents about $1.1 million in revenue. You'd be surprised how many sheriffs would be willing to be customer friendly for that kind of money. Especially if word got out that Harris county dragged its feet, but the Montgomery County Sheriff did a bang-up job, and Montgomery County started getting all that revenue from Harris county residents. Give people the choice for local control.

Yes, I know that. My question was whether that would be acceptable to DPS.

I think this type of situation would be much improved if the DPS online CHL status actually better shows the state of the application. Instead of "Application Processing" for months (in case of a letter sent waiting for further information), actually showing "Awaiting Application Response" would help an applicant to know that they might not have received something from DPS which they should chase.

Updating the status takes manpower and dollars. Would you rather have people spend their time processing your CHL application or updating the computer?

Agreed, but with the highest CHL application fee in the country, I would think that money could well cover a bit better status updates on the CHL status check portion of the DPS site.

Personally I think that justification for the highest fee in the country should be shown or that fee reduced.
