This has come up in previous posts, but I don't think that there is any caselaw. Until then, I will leave my switchblade, sap and brass knuckles at home on my nightstand.

:iagree: and I'd prefer 2 pistols to 1 pistol and a set of knuckles (or 3 pistols to 1 pistol, a set of knuckles and an "illegal" knife") any day

I'd rather just carry a loaded AK-47 in a tennis racket--guitar case when they post a 30.06 sign.
Then I'm not violating 30.06
I'll let others worry about if the shape of the blade makes their knife illegal or not and let them carry an "illegal knife" only to places where they can also carry their concealed handgun legally.. ;-)

guess I'll get a tennis bag at Wally World viewtopic.php?f=23&t=55538&hilit=tennis" onclick="window.open(this.href);return false;

Academy is too far away to get a Pool Cue case for my Rem 870 shotgun folder before my appointment, so I'll either need to take a Calico 9mm Carbine with the 100 round magazine or the SKS with a 50 round mag ... SKS is cheaper/easier to replace in case of loss (Seton Medical group seems to "Mess up" oopsie medical tests sometimes, but I'm just going for a scan ... I hope)

We had nothing to do since government implemented it. All we need to do is just to follow them. I know it's not right but they had the power then.

Military knives that are intended primarily for use in a role other than combat are typically referred to by their primary role.

Bumping this post because there may soon be some case law on the subject.

First time I have heard this, got a source?

I posted before about the law, Mr. Charles Cotton, responded with a warning that this is not the intent of legislature, but as far as my English language skill it is a valid exception.

I Didn't Beat the Ride - Illegal Knife + CHL + Concealed Handgun = Jail + Charges

Will be interesting to see how his case plays out. Pretty dumb that you can't carry an auto knife or a large knife but you are allowed to carry a handgun.

We had some more discussion in this thread also:

Does the CHL allow carry of other weapons

I like others believe that the guy is toast, he will loose his license for 7 years after his conviction. My reason behind this is that there are too many other things spelled out as exceptions in the code, such as clubs and security guards weapons of all types for the military, it says no place that the section about illegal knives that just because your carrying a weapon and have a CHL that you may ignore the illegal knife provision, the illegal knife provision is however exempted within the code at certain places and times and that exemption says nothing about CHL and weapons. the CHL section also goes further and says carrying a firearm of the type stated on the license. so I believe he will loose the case and have a conviction.

Well, it looks like reading comprehension trumps speculating on what the legislative intent may have been.

So it turns out the charge was dropped a couple of weeks ago on the advice of a county attorney and approval of a county judge, all "in the interest of justice."

They read the law in question and agreed that the charge was bogus.

So, there is no longer any speculation. THE LAW SAYS if you are have a CHL and are carrying a concealed handgun, then Section 46.02 does not apply to a you. This is good news.

His license stays tight.

Glad it worked out for him but I think I'll stick to knives officers will want to admire and hand back to me as opposed to knives they will want to keep in exchange for a nice pair of bracelets.
I wonder how long it took him to get back his weapons and his CHL?
