I took it as he was covering in either a shoulder/IWB/OWB on his right side with his jacket. Had he exited the vehicle without the coat, it would show his gun and would not be concealed any more. Just like it would not be concealed any more were you to open the door...nothing to cover it.

I learned many moons ago to take why a person was arrested with a grain of salt until I read the reports. They always downplay or minimize what they did. I would bet this incident is no different.

I regularly carry using a Sneaky Pete holster. It is ideal to drop in the door pocket or simply lay on the console or seat next to you. Completely conceals the gun.

If the gun is in the door pocket then it is not concealed. What does the person do when they exit the vehicle in a public parking area? Crawl out the window like "The Dukes of Hazard"?

Find a better place to conceal your gun.

Look at the top photo (just posted). The gun is concealed yet very accessable.

Really? I looked at both pictures, and I didn't see ANY guns.

In fact, they look like the packet I got my owners manual(s) in for my last car.

Same here. All I saw was a leather pouch of some sort. I have put my gun on the passenger seat and thrown a shop wrag over it. Poof... Concealed. :mrgreen:

Once he has removed his body it is visible by people walking by. It is not concealed in this location unless he also has something over it.

Yes, I realized that but I guess I wasn't thinking about the original question. A red rag or ball cap should be sufficient to cover the gun.

Yup..plus let's hear the real story on this arrest. Provide a name and arresting agency and we keep request the case. I'll be there is more to this story...

The gun most certainly is concealed when the door is closed. It was "in plain view" only when the driver obeyed a lawful order of an officer. Why do you doubt that such an arrest?

The MPA law only protects motorists if the handgun is not in plain view. Unlike CHL, there's no intent to display required. If it's in plain view, there's no MPA protection according to the black letter law, even if it's accidental. Same as it doesn't matter if you think she was 18, when she's really 16. No mens rea is needed to convict.

For the young man arrested, without pictures it's impossible to know if was in plain view with the doors closed.

The OP states he heard this second hand. This may have happened or may not have happened. We don't know. In my experience when you pull the reports they are usually a lot different then what was said, and this wasn't said from the alleged person that was arrested. There is probably more to the story. In fact I would hope there was more then a legally carried gun in the door resulting in an arrest.
