When thinking about this or similar scenarios, I am crystal clear that I have no duty to act light like Buzz Lightyear ("
Reach for the sky!"), command them to "
Drop the weapon", or otherwise provide any warning of my impending hostile action. Their first warning is a muzzle report which they may or may not be alive to hear.

RIP. What a shame. Died while trying to protect a loved one. My deepest condolences to the family.

There is no law stating you must warn somebody first. He would not be the first Leo to die after giving a warning and loosing the element of surprise. Very tragic
