In Texas, at least, a Murder charge would result in an acquittal. Murder requires that a person intentionally or knowingly cause the death of another, or to cause the death of another while committing a felony or while escaping after doing so.

Criminally Negligent homicide would be the proper charge, and from they way it appears, he should be.

Your fishing with your grandchild, as happy as you two can be when all of a sudden, he's killed by a stray bullet. From a cop shooting at a friggin snake :(

OOHHH I made a typo. Flintnapper was joking around with me. My use of the word "they" in my respnse to Hoss4570 was not because he mispelled it, but he used a plural. Only one officer fired and only one should suffer any criminal charge.

But I appreciate the hostility and quick to jump to conclusions from those of you who jumped on that. :roll:

Okay, here is the scorecard for those who are confused:

1. Hoss wrote that "Thay are not above the law."
2. TXI responded "They?" -- but he wasn't challenging the spelling, he was challenging the plural, because only one officer took that shot.
3. In TXI's response, he wrote "they" for "the".
4. Flintknapper, thinking TXI had been picking on Hoss's spelling, pointed out the typo.

Okay boys and girls... back to our regularly scheduled discussion.

I disagree. 3 dumb donkeys conspire to shoot a snake in a tree with a handgun, and only one should be charged???
And why are they, the authorities, trying to conceal ALL information about this incident, by not even giving basic information out. That smells worse than the homicide itself.

Just so there is no confusion, I only "pick at" TXI because I like him. I admit....I could not resist the temptation to quote his post, but it was all in fun...and meant to be light hearted.

I don't care if anyone is "hooked on phonics" or has a peeve about the singular or plural of things. I enjoy exchanging ideas with the many fine people here. Sometimes I take a friendly jab at some of the folks I know....and I expect the same from them. :smile:

NOBLE, Okla. (AP) _ There are now three Noble police officers on administrative leave after 5-year-old boy was killed Friday by a bullet fired by an officer at a snake.

Their names haven't been released. Police Chief Ben Daves says the three are on leave pending investigations by both the Oklahoma State Bureau of Investigation and Noble police.

Daves says in a statement released today officers fired two shots at the snake about 7:30 Friday night and a bullet from a .40 caliber gun hit 5-year-old Austin Haley in the head as he fished with his grandfather.

The boy was pronounced dead at Norman Regional Hospital.



Apparently 2 rookies and a 5 year veteran were there.

NOBLE — A police bullet that killed a small boy last week had been aimed at a black rat snake, a Norman animal control officer said Tuesday.

After the shooting on Friday that killed Austin Haley, 5, Norman's animal control department was called to collect and store the dead snake, Noble City Manager Bob Wade said.


Noble doesn't have an animal control officer, he said.

The snake has been frozen and stored for investigators, Norman Police Chief Phil Cotton said.

The incident started when Noble police officers responded to a call from a resident who thought a rattlesnake had slithered up into a birdhouse.

One of the two shots fired by police hit Austin while he was out fishing with his grandfather. His funeral is today.

Police fallout
Noble Police Chief Ben Daves said the city has been without an animal control officer for about a month, so police responded.

The Noble Police Department's Police and Procedures Manual says "firearms may be used to destroy an animal that represents a threat to public safety.�

The manual states "firearms shall not be discharged when it appears likely that an innocent person may be injured.�

The three officers involved in the shooting are on paid administrative leave pending the outcome of investigations by Noble and the OSBI.

The names of the officers involved have not been released.

In the meantime, the seven officers remaining on the police force are working overtime to cover the shifts, Daves said.

A snake in a birdhouse in a semi-rural area does not qualify as a threat to public safety. Even if it was a rattlesnake. (Anyone ever seen a rattlesnake in a tree? Not me!) Rattlesnakes in central Oklahoma are about as rare as Sooners fans.
