Before this is taken the wrong way I wanted to say that it's not because of any hate/animosity I have for Law Enforcement. It's just that I know if a civilian had made a mistake they would be prosecuted to the fullest. Now, since this is an officer it's trying to be swept under the rug and forgot about it seems. It is unfair to think just because it was law enforcement that they should go unpunished. I'm not even saying that he should be terminated. However, he should have some sort of notice put in his file that if he repeats something of this sort he should then be terminated.

Anyone ever heard the phrase, " Ignorance of the law is NOT an excuse."

I think it should work both ways. Even if the officer didn't know it had to be an intentional display of the firearm he should be held accountable. Just like a civilian would be held accountable for their actions.

Thanks but according to my attorney false arrest is hard to prove. The NRA and other organizations have little or no interest in my case so I will not pursue this. Unfortunately this will happen again. If your gun is identified in Round Rock you will go to jail. Your CHL means nothing to the RRPD, in fact they will tell you that you will not get it back with glee. The law states that the gun must be intentionally, recklessly or purposefully exposed to be in violation of the law but you won’t have time to educate the arresting officer. You will be cuffed and taken for a ride while the officers involved pat themselves on the back. :banghead:

It just seems so strange.
Apperantly I should be able to get a copy of the police report and 911 call. These are public records and all I have to do is file an Open Records Request for the items and legally they have to provide them . I have been busy making a living and have not done so. I will post it here when I get the results.

I don't know what's involved in an Open Records Request but If you have to make it in person or pick up the documents in person take a witness or better yet a lawyer with you to avoid any possibity of the type of treatment the guy in Carrollton said he received at the police station. i.e. Assault and intimidation. Or maybe get a button cam.

That's encouraging news. I'm sure the officers you encountered are not representative of the force.
