I like the direct approach first. If you cannot get your gun back through a direct, courteous contact with the department, then it's time to get your lawyer involved. IANAL.

Dealing with HPD can drive you crazy. My husband was arrested for doing something stupid while down there on business. The bail bond places I talked to initially all told me you can get arrested for just about anything in that town. He has been to court 4 times and the lawyer is never ready because the dept never seems to be able to send the lawyer the evidence info he needs yet the court still requires him to appear. It's like groundhog day. Trying to get them on the phone for anything takes an all day camp out on hold. My car, which he was driving, was towed after the arrest and none of the 10 people I talked to could tell me where the car was for almost 24 hours. I took the advice of one kind policeman I talked to who told me to just report it stolen and they would suddenly be able to find it. Worked like a charm. They found it in 10 minutes. If you look on the internet, you will find out towed cars there regularly end up in auctions and owners often can't find them. It's a racket. I would say if you live in that town, go to great lengths to avoid the attention of the police. It's not that they are all bad, its that the entire legal system seems to be a madhouse and there is little sympathy for the people caught in it. Just my personal experience, which I will never let the spouse now living in the doghouse to forget.

Now on the third page of responses, and we have yet to hear from the original poster. Guess he's in jail!

Sheree,
While I understand your frustration, punishing your husband into perpetuity is a pretty strong marriage corrosive...unless of course that's your intent...

Based on the one sided view of this...
The LEO oppressed to OP, confiscated his property, without a receipt or citation?
If this is the case I see a theft of firearm charge against the LEO
along with a few other charges including violation of civil liberties $$$$$$

Not saying there is. Saying there may be.

Just a quick note about hubby in the dog house. I don't want you guys to think I am a heartless woman. The stupid thing he did was with a "lady" of the evening who happened to be an undercover cop. Found out there has been a regular pattern of these activities for our entire marriage...nope, he is doing time in the dog house for quite a while.

You're a much more forgiving woman than my wife would be about something like this. I would not be able to post here for quite awhile until I got out of the hospital, much less the dog house.
Hope all works out for the best for you guys!

The gun was stolen if he didn't get a receipt.
I would report the theft before it gets used in a crime or for a drop gun.

To all:
Regarding the 'receipt' for the confiscated gun.
The OP's hard to read gigantic paragraph stated down towards the
bottom "I've got to go to court now".
So if he has to go to court, there would have to be some kind of paper
trail of a written citation. But it was not clearly elaborated upon.

Dude its HPD! Just hire an attorney. You will be fine.
Dont worry about the stupid threats. They mean nothing and in a court of law they will change their verbage.

My first advise to the original poster would be to lose the high maintenance girl friend.
