IANAL, but I do not read the statute this way. I read it that IF there is a proper sign and IF you walk past that sign into the premises while carrying, THEN you have just committed an offense under the statute and can be arrested for Class A misdemeanor.
(2) received notice that:
(A) entry on the property by a license holder with a concealed
handgun was forbidden; or
(B) remaining on the property with a concealed handgun was
forbidden and failed to depart.
The relevant word above is "or", and section (A) applies if you walk past a proper 30.06 sign, not section (B)

Does this make sense? Do I have this right?
The thing that bothers me in the way it is written is that if you are already guilty once you cross the threshold as stated in part A, then why have a part B which indicates that you went in, were asked to leave and refused to leave. You cannot reach part B without going through part A first. Either you are pregnant or you are not. Maybe some lawyer can explain. :confused5

(A) means you had proper notice PRIOR to entering the property (written or verbal)
(B) means you received notice AFTER you entered the property (for example, no sign, but received a verbal notice after entering) and failed or refused to leave

A little nit-pick, I could not resist.
You should say "incompetent" lawyers. IMO most lawyers are not poor, particularly the ones working for large firms.
Thanks. I knew there was something wrong with that as I typed it, but just couldn't think of a better word at the time. :grumble

Please include a spoiler alert next time. I didnt know that sign was there so it must not have been conspicuous.

This forum just woke me up and made me aware that I need to look a little harder for the 30.06 sign at AMC 30 in mesquite. The wife and I have been going to this theater since 1995 about 4 or 5 times a year.Last Saturday was the first time that I noticed the sign at the front door ,almost at ground-level.I almost had to get on my knees to read it.Regardless of the sign being "legal" or not,I e-mailed AMC that I did not feel safe in their theater and would not attend in the future, until sign was removed.CHLs need to e-mail or phone these folks and let them know that the criminals do not care about the signs and we will take our buisness elsewhere.

[quote="kauboy"]I was at the AMC theater in the Parks Mall in Arlington with the little lady. We were going to see "The Ugly Truth" (great man's man movie, wife loved it, don't take the kids ;-) )
Anyways, while we were getting our tickets, I looked down at the lower corner of the glass window pane, and there it was.
Worded to a 'T', English and Spanish.
I got squeamish...
I mumbled to my wife that I'd have to go back to the car, but then took another look... Sure enough, there was no possible way it was big enough. Easily smaller than 8x11.
So... I had a decision to make. I could walk all the way out to the parking lot and disarm to adhere to an improperly posted sign, or I could disregard it and take my chances if anything unexpected happened.

I don't like disarming when I don't absolutely have to, and I relish the technicalities that make the law so verbose.
You can probably guess which I chose.

So, I have to ask...
Do y'all think I did the right thing, or no?
Has anyone else been faced with this decision there?

( I did find the Parks thread, and saw that the Parks itself isn't posted. I also found the general AMC thread, but didn't find any answer addressing any size issue. 13 pages, maybe I missed it. Apologies if so.)[/quotef
I say ya did good. If the sign is impoperly posted it isn't valid. It would take a "pertenant" representative of the theater to say something to you for it to be an issue.

On that particular visit I would have gone on in and watched the movie while armed. But then I would never go back to that theater again. As a matter of fact, after reading that AMC is anti 2nd amendment on this forum, I decided to never go to an AMC.

Please go to Texas3006.com when you get info about posted signs and add to their databank about signs across Texas. It'll help us all. Thanks. :txflag:
