Worse than pulling teeth, seems they don't update the system as quick as they should, should be real time updates IMHO...

I had to put down an assault arrest that was expunged.. Charges dropped.. Anybody think this will slow my app down?

i was arrested for auto burglary and larceny charges, after talking to the judge the charges were reduced to attempted auto burglary and the larceny charge was dismissed. the problem, im thinking, is that there were no records of the disposition from the county clerks office. i had them send a letter on their letterhead that relayed the fact that there were no records (it was from 1997)

i called the DPS and asked if they had everything they needed and they said, 'yes. we are reviewing your background and have everything we need at this time. we will contact you if more information is needed.'

*shrug*

i'll give them a call next week sometime, i guess.

id rather they work on getting my CHL to me than updating the website... but thats just me. :thumbs2:

Got you. Well I called in yesterday to make sure I had everything in because my fingerprints and bg check were still pending and talked to a really nice lady. She said that she had it all but said a lot of people were in line ahead of me. I think calling speeds things up because my status was changed this morning. All green lights!!!

Well there is some truth to that, when I was 17 (1992) I got arrested in Massachussetts. The charges were continued to another date and then dismissed. Now the tricky part is that Texas sees that as a conviction under the "defferred judication" clause in the chl processing which made me inelligable for my chl... but they changed the law
Effective September 1, 2009 1. Definitions of ‘Conviction’ and ‘Felony’ Section 411.171 is amended to exclude from the definition of „conviction those convictions or orders of deferred adjudication that have been: "vacated, set-aside, annulled, invalidated, voided, or sealed."
so I contacted a lawyer in Mass. and asked to have my record sealed.... when he looked it up he told me "your charges are dismissed, why would you care to seal them?" I explained the whole mess about texas interpritation of it. So for a small fee ($1000) he had my record sealed.
On my application for chl I disclosed my arrest and the charges and the dismissal and the sealing of the records (CYA, and included a copy of the sealed records documents that lists the charges.
I called the Dps about 3-4 weeks to verify they had everything, they did. They said an investigator was asigned to me case to look into the charges and see if they were disqualifing. But they were dismissed and sealed I told them (very nicely) and reminded them of the law change from sept 09. so 3-4 weeks later no status change no requests for info and no denials... I have to wonder is this investigation that hard or time consuming? Because it took me about a week to order and have my criminal record mailed to me, which now states "no adult record" cause it also seals the arrest. And A quick call to the department of probate courts or whatever its called (from a government agency) will turn up the record of sealing.
anyhow i should be covered under the law... its just annoying at best to wait around.. lol

On my criminal record I had two assults, a grang jury indictment, and a grand jury no bill, didn't seem to delay my background check, went to the criminal court house got the records and sent them in with my app, just waiting on the mailman to bring my plastic now..good luck

checked today, as i have for the last 2 weeks (at least twice per day, lol) and to my surprise - all is green!!!

obviously, the application is still showing 'received' but from what i can tell, that's going to remain that way permanently. my manufacturing status reads, 'pending' so hopefully within the next couple of weeks - they'll create my plastic and send it to me!!!

so excited, so happy.

Haha I check way more than twice a day!! Mine was manufacturing pending for one day! Yesterday.. Now it's manufacturing.. I live real close to Austin so I'm hoping to see it by Wednesday. Friday at the latest!! Yaaaa buddy!!

A no-bill is when a grand jury determines that either a crime was not committed, was justified, or there's not enough evidence to actually file charges and go to court on it.
